RESOLUTION 21-02 COMMISSIONERS MEETING DATES WHEREAS, 7-5-2122, MCA, requires that the governing body of the county shall establish by resolution, regular meeting dates and notify the public of those dates; and WHEREAS, the Board of County Commissioners of Lake County agreed to hold regular meetings every Monday through Thursday throughout calendar year 2021, between the hours of 10:00 am to 12:00 pm and 1:30 pm to 4:40 pm, unless otherwise posted; and WHEREAS, the Board of County Commissioners of Lake County is also authorized to set regular office hours for the Lake County Courthouse and desires to do so with this resolution; and NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Lake County hereby sets regular Commission meeting dates as every Monday through Thursday, 10:00 am to 12:00 pm and 1:30 pm to 4:30 pm, in the calendar year of 2021, provided that there is business on the agenda; and BE IT FURTHER RESOLVED that meetings may be called or cancelled by the Board of County Commissioners as necessary to conduct county business at a time and place to be announced by proper public notice, and that, as public notice is required by 7-5-2122 MCA, this Resolution will be published for two consecutive weeks in the Lake County Leader newspaper in January 2021, and BE IT FINALLY RESOLVED that this Resolution is to have an immediate effective date. Notice of Annual School Election Notice is hereby given by the Lake County Election Administrator, State of Montana that the Annual School District Election will be held on Tuesday, May 4, 2021, by mail ballot. Ballots may be mailed or returned to the Election Office at 106 4th Ave E, Polson, MT 59860 between the hours of 8:00 AM - 5:00 PM from April 19th - May 3rd and 7:00 AM - 8:00 PM on Election Day, May 4th. Electors will consider the following issues at the election: Upper West Shore Dayton School District #33 - One 3-year trustee position; Ronan School District #30\1- One 3-year trustee position. Ballots will be automatically mailed to all qualified electors on April 19, 2021. LEGAL NOTICE BLACIC FLOODPLAIN DEVELOPMENT PERMIT & VARIANCE REQUEST Ron and Kathy Blacic have submitted a floodplain development permit application and a variance request for development located within the 100-year floodplain associated with Post Creek along Dublin Gulch Road. Development of the property initially took place prior to FEMA's flood insurance rate map (FIRM) being adopted by Lake County. However, after the FIRM was adopted by the county, additional development of the property was conducted by previous owners without obtaining a floodplain development permit. The current owners are requesting permit approval for post-FIRM structures constructed by the previous owners which include an attached garage with upper level living quarters, a detached garage, woodshed, greenhouse, utilities, propane tank, a berm water/diversion, and miscellaneous landscaping. The applicants are proposing, where necessary, to modify the existing improvements so they will be reasonably safe in the event of a 100-year event. This includes removal of some improvements and flood proofing of other improvements, bringing them into compliance with county floodplain regulations. The exception to this is in regard to the variance being requested to allow existing non-flood resistant building materials to remain in the attached garage less than 2 feet above the base flood elevation. The applicants have also applied to install a new septic system which includes a raised mound drainfield located within the conveyance shadow of the existing residence. The subject properties are legally described as a portion of the SESE of section 22, further described on Deed Exhibit H-799, and a portion of SWSW of section 23, further described on Deed Exhibit H-807, both located within T19N and R20W. PUBLIC OPPORTUNITY TO PROTEST TRANSFER OF OWNERSHIP OF MONTANA ALL-ALCOHOLIC BEVERAGES LICENSE CHEEZIN OUT LLC (Jenna Marie Corcoran, Owner(s)) has applied to transfer Montana All-Alcoholic Beverages License No. 15-999-3713-002 to be operated at THE PIGASUS BAR, 92637 US Highway 93, Arlee, Lake County. The public may protest this license transfer in accordance with the law. Who can protest this transfer? Protests will be accepted from residents of the county of the proposed location Lake County, residents of adjoining Montana counties, and residents of adjoining counties in another state if the criteria in 16-4-207(4)(d), Montana Code Annotated (MCA), are met. What information must be included? Protest letters must be legible and contain (1) the protestor's full name, mailing address, and street address; (2) the license number 15-999-3713-002 and the applicant's name CHEEZIN OUT LLC; (3) an indication that the letter is intended as a protest; (4) a description of the grounds for protesting; and (5) the protestor's signature. A letter with multiple signatures will be considered one protest letter. What are valid protest grounds? The protest may be based on the applicant's qualifications listed in 16-4-401, MCA, or the grounds for denial of an application in 16-4-405, MCA. Examples of valid protest grounds include: (1) the applicant is unlikely to operate the establishment in compliance with the law; (2) the proposed location cannot be properly policed by local authorities; and (3) the welfare of the people in the vicinity of the proposed location will be adversely and seriously affected. How are protests submitted? Protests must be postmarked to the Department of Revenue, Office of Dispute Resolution, P.O. Box 5805, Helena, Montana 59604-5805 on or before April 11, 2021. What happens if the transfer is protested? Depending on the number of protests and the protest grounds, a public hearing will be held in Helena or Arlee. All valid protestors will be notified of the hearing's time, date and location. Hearings typically are scheduled within 90 days. A protester's hearing testimony is limited to the grounds in the protester's letter. Following the hearing, the Department of Revenue will notify the public whether the license transfer is approved or denied. How can additional information be obtained?
