Groundrules outlined for Wal-Mart hearing

For the past several months, in anticipation of an application for a new Super Wal-Mart, much public discussion has been generated. Wal-Mart has now submitted their application for four related permits or approvals related to that project.

They are: A minor subdivision; a special use permit for one lot in that three-lot subdivision; a zone change; and annexation of the property south of the existing Wal-Mart store.

The City-County Planning Board (CCPB) will conduct a public hearing on Tuesday, May 9, in the Polson High School auditorium followed by board discussion and potentially a decision to recommend to the city council an approval for two issues, the zone change and the subdivision.

Additionally, the CCPB shall discuss and make a decision on the request for a "special use permit" for the SuperWal-Mart.

The Board understands this project is of great interest to the public and in accordance with the provisions of the city codes, all interested parties are encouraged to submit written comments in advance of the meeting or to address the Board at the meeting … Written comments were due no later than Monday, April 24 at 5 p.m.

Those who wish to address the Board will be required to register by printing their name and address on a sheet located on the front table. That sign-in sheet will be available beginning at 5 p.m. before the start of the 6 p.m. meeting.

The purpose of the sign-in is to provide the chairman with the number of individuals who wish to make a statement to the Board.

If a large number of citizens wish to address the Board, each individual will be limited in the duration of their initial testimony. Following each comment, the Board members may ask questions. All communication between the public and the Board shall be through the chairman.

At the conclusion of initial public testimony, the individuals offering comment shall be given an opportunity to rebut others' testimony or to clarify their own. The second comment period may also be limited in duration, again depending on the number of individuals making initial statements. Again, questions may be asked by the Board.

Once the public hearing is closed by the Chairman, there shall be no further public testimony. At the completion of the public hearing, the Board shall discuss and take action consistent with the code.

Board members have observed the intensity of some of the opinions on both sides of the issues that will be discussed. As the Chairman, it is my responsibility to ensure that the meeting b e conducted in a decorous manner, following the procedures in the code. I am confident that all comments will be restricted to the merits of the application and the compliance with, or lack of compliance with, the plan and regulations.

Copies of the application and the 1993 Development Code are available for perusal during business hours at the City Planning Office. Copies of document, including the Code, may be purchased from the City Planning Office.
