Lake County District Court, Judge McNeil presiding

*The following district court proceedings took place April 7.

-State of Montana vs. Cheryl Matt; 40. The matter before the Court is sentencing on revocation. The Court commits the Defendant to the DOC for 10 years with five suspended. The Court specifically recommends that the DOC consider Defendant for placement in either Elkhorn or Passages, whichever the department feels is appropriate. Defendant is to receive credit for time while in custody. All previous conditions are re-imposed.

-State of Montana vs. Alan Howlett; 31. The matter before the Court is change of plea. Defendant admits committing the offenses of criminal endangerment, a felony, Count I and driving under the influence of alcohol or drugs, first offense, a misdemeanor, Count II. The Court makes its findings, accepts the plea and finds the Defendant guilty of the charges. PSI ordered. Sentencing is set for May 12 at 9 a.m.

-State of Montana vs. Allen M. McDonald; 48. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to the charge of driving under the influence of alcohol or drugs, Count I and threats and improper influence in official and political matter, Count II, felonies. The plea is entered and the case will be set for trial. The Court sets this matter for omnibus hearing on May 6 at 9 a.m.

-State of Montana vs. Marc Friscia; 21. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to the charge of tampering with evidence, a felony, Count I and criminal possession of drug paraphernalia, a misdemeanor, Count II. The plea is entered and the case will be set for trial. Attorney Britt Cotter indicates that this matter was dismissed in justice court with prejudice and the Defendant was unaware that a warrant had been issued. At this time Mr. Cotter is requesting the Defendant be released on his O/R. No objection by the State. Request granted. The Court sets this matter for omnibus hearing on May 20 at 9 a.m.

-State of Montana vs. Vincente Laroche; 31. The matter before the Court is arraignment. Ready to enter plea, the Defendant pleads not guilty to the charge of assault with a weapon, Counts I, II and III, and criminal endangerment, Count IV, felonies. The plea is entered and the case will be set for trial. At this time Attorney Caroline Riss is requesting a modification of the Defendant's conditions to allow him to travel throughout the state of Montana for work related purposes. No objection by the State. Request granted. The Court sets the matter for omnibus hearing on May 20 at 9 a.m.

-Martin, Delane R.; 38. Driving a motor vehicle while privilege to do so is suspended or revoked. Fined $500 and 180 days in jail with 175 suspended. Provide proof of valid DL by 4/12/10 and jail reduced two days.

-Butterhof, Cindy L.; 47. Reckless driving. Fined $300 and 90 days in jail with 90 suspended.

-Munson-Young, Rachel C.; 30. Operating with alcohol concentration of 0.08 percent BAC or greater - first offense. Fined $300.

*The following city court proceedings took place April 3-9.

-Wier, Andrew D.; 22. Operating without liability insurance in effect - first offense. Fined $250.

-Newman, Victor A.; 26. Driving a motor vehicle without a valid driver's license - expired less than 180 days. Fined $150. Habitual offender operating motor vehicle. Fined $400 and 14 days in jail. Operating without liability insurance in effect - first offense. Fined $50.
