*The following district court proceeding took place June 10.

-State of Montana vs. Gyme Kelly; 54. The matters before the Court are arraignment, omnibus hearing and answer petition to revoke. Defendant pleads not guilty to the charge of assault with a weapon, a felony. The plea is entered and the case will be set for trial. At this time, attorney Ben Anciaux indicates that the Defendant had previously posted a $50,000 bond in DC-10-42 and is requesting that bond run concurrent with this matter and DC-04-86. State objects. The Court will run all matters concurrent along with the condition the Defendant wear the SCRAM bracelet. Mr. Anciaux is requesting DC-10-42 and DC-04-86 be continued also to be set with DC-10-92. At this time the Court indicates it has a potential trial date of July 29 for DC-10-42. Mr. Anciaux indicates he will file a WST. Upon the filing of a written WST signed by the Defendant, continuance is granted. The Court sets these matter for July 15 at 9 a.m.

-State of Montana vs. Carlos Hernandez; 22. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to the charge of burglary, a felony, Count I and criminal mischief, a felony, Count II. The plea is entered and the case will be set for trial. The Court sets this matter for omnibus hearing on July 15 at 9 a.m.

-State of Montana vs. Justin Teigen; 29. The matter before the Court is adjudicatory hearing. Attorney Ben Anciaux indicates the defendant will be admitting some of the allegations. The Court finds the admissions are sufficient and the Defendant's suspended sentence is revoked. The parties are prepared to proceed to sentencing. The Court commits the Defendant to the DOC for a term of five years with two years suspended with the recommendation for Connections Corrections and pre-release. The sentence imposed shall run consecutive to the sentence imposed in DC-08-3.

-Schuffert, Pamela R.; 58. Driving without a valid drivers license - expired more than 180 days. Fined $250. Speeding -exceed restricted/special zone speed limit established by Department. Fined $60.

-Skipton, Amber M.; 22. Driving without a valid drivers license - expired more than 180 days. Fined $100.

-Lewis, Mistie A.; 41. Negligent endangerment (substantial risk - death/serious bodily injury) - Misdemeanor. Fined $1,000.

-Olson, Nicholas A.; 24. Driving without a valid drivers license - expired more than 180 days. Fined $250 and 180 days in jail with 180 suspended.

-Ward, Allie M.; 21. Operating without liability insurance in effect - second offense. Jailed 10 days with 8 suspended. Provide proof of six months continuous insurance by Dec. 1 and jail waived.

-Welsh, Lois T.; 44. Reckless driving. Fined $50.

-Dubuque, Daniel P.; 28. Driving under the influence of alcohol - first offense. Fined $400 and 180 days in jail with 179 suspended.

-Phillips, David A.; 32. Fail to carry proof or exhibit/insurance in vehicle - second offense. Fined $350 and 10 days in jail with 8 suspended. Provide proof of six months continuous insurance by Dec. 1 and jail waived.

Lake County District Court, Judge McNeil presiding

*The following district court proceedings took place June 9.

-State of Montana vs. Sheldon Haynes; 21. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to all charges. The plea is entered and the case will be set for trial. The Defendant remains at liberty. This matter is set for omnibus hearing July 14 at 9 a.m.

-State of Montana vs. Vincent Curley; 30. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to all charges. The plea is entered and the case will be set for trial. The Defendant remains at liberty. This matter is set for omnibus hearing July 14 at 9 a.m.

-State of Montana vs. Jesse Finley; 21. The matter before the Court is omnibus hearing or change of plea is DC-10-62 and for status conference or change of plea in DC-09-119. Attorney Steve Eschenbacher states that the omnibus hearing has been held in DC-09-119 and the Court concurs that the omnibus hearing was held on Dec. 9, 2009 in DC-09-119. Omnibus hearing held in DC-10-62. Mr. Eschenbacher moves for a bond reduction in both cases. The State objects. Bond reduction denied. The Court asks the Defense if both cases can be addressed concurrently. Mr. Eschenbacher states that both cases are to be tried separately.

-State of Montana vs. Francine Smith Vanmaanen; 57. The matter before the Court is sentencing. In DC-10-35 for the offense of driving under he influence of alcohol or drugs, fourth or subsequent offense, a felony, the Court commits the Defendant to the DOC for placement in an appropriate correctional facility or program for a term of 13 months. In addition the Defendant is sentenced to the DOC for a period of five years with all five years suspended. In DC-08-87 for the offense of criminal endangerment, a felony, the Court commits the Defendant to the DOC for a period of five years with all five years suspended and to run consecutive to DC-10-35.
