Lake County District Court, Judge McNeil presiding

*The following district court proceedings took place June 16.

-State of Montana vs. Nicole Hadley; 29. The matter before the Court is change of plea. Defendant admits committing the amended offense of criminal endangerment, a felony, Count I and admits committing the offense of driving a motor vehicle while privilege to do so is suspended or revoked, sixth offense, a misdemeanor, Count II. The Court makes its findings, accepts the plea and finds the Defendant guilty of the charges. The Court grants the State’s motion to dismiss Count III. PSI ordered. Sentencing is set for July 21 at 9 a.m.

-State of Montana vs. William Durgeloh; 50. The matter before the Court is change of plea. Defendant admits committing the offense of threats and improper influence in official and political matters, a felony. The Court makes its findings, accepts the plea and finds the Defendant guilty of the charge. PSI ordered. Sentencing is set for July 21 at 9 a.m. The Court orders counsel to have the county attorney contact the probation office to prepare the PSI. The Court orders Defendant can expect that the sentence to be imposed will be a deferred sentence for three years and Defendant is ordered to serve 41 days in the LCJ. The Court orders Defendant is authorized to be released today. The Court further orders that attorney Britt Cotter make sure Defendant knows it’s his responsibility to contact the probation and parole office to complete PSI.

-State of Montana vs. Ghlee Blickenstaff; 22. The matter before the court is omnibus hearing. Defendant admits committing the amended offense of criminal endangerment, a felony, Count I, the offense of partner or family member assault, a misdemeanor, Count II, and the amended offense of cruelty to animals, a misdemeanor, Count III. The Court makes its findings, accepts the plea and finds the Defendant guilty of the charge. PSI ordered. Sentencing is set for July 29 at 9 a.m.

-State of Montana vs. George Moore; 55. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to the charge of driving under the influence of alcohol or drugs. The plea is entered and the case will be set for trial. The Court sets this matter for omnibus hearing on July 22 at 9 a.m.

-State of Montana vs. Allen McDonald; 48. The matter before the Court is sentencing. PSI has been received and reviewed. For the offense of driving under the influence of alcohol or drugs, a felony, the Court commits the Defendant to the DOC for a term of 10 years as a persistent felony offender, with five years suspended to run consecutive to DC-97-67. The Court recommends the Defendant be considered for placement in WATCH followed by pre-release. All conditions of probation, fines and surcharges in the plea agreement and all conditions by the probation office are incorporated by reference.

-Aguiluz-Rivas, Manuel E.; 46. Driving without a valid driver’s license - expired more than 180 days. Fined $250 and 180 days in jail with 178 suspended. Credited one day.

-Holmes, Timothy H.; 62. Reckless driving. Fined $300 and 90 days in jail with 83 suspended. Speed - exceed restricted speed limit established by local authority. Fined $50.

-Arlet, Mary H.; 46. Fail to carry proof or exhibit insurance in vehicle - first offense. Fined $150.

-Retallick, Robert H.; 43. Operating without liability insurance in effect - first offense. Fined $150.

-Lemler, Franklin E.; 48. Operating without liability insurance in effect - first offense. Fined $150.

-Asa, Jeffrey C.; 21. Driving under the influence of alcohol - first offense. Fined $400 and 180 days in jail with 179 suspended.

-Cooper, Donald G.; 59. Careless driving. Fined $50 with $526 in restitution. Operating without liability insurance in effect - third or subsequent offense. Fined $400 and $526 in restitution.

Crimestoppers

On June 13, 2010 Main Street Storage in Polson reported to have been vandalized between the evening of June 12 and the early morning hours of the 13th. Based on evidence left at the scene, Polson Police Department is looking for a dark colored 1989 Ford Ranger or Bronco with front drivers’ side headlight damage.
