*The following district court proceedings took place April 28.
-State of Montana vs. Ricky Scott Riebe; 49. The matter before the Court is sentencing. PSI has been received and reviewed. For the offense of tampering with witnesses and informants, a felony, Count I, the Court defers imposition of sentence until Sept. 1, 2011 on Count I. For the offense of privacy in communications, a misdemeanor, Count II, the Defendant shall be sentenced to the LCJ for a term of six months will all suspended on Count II. The sentence imposed on Count II shall run consecutive to Count I.
-State of Montana vs. Joseph Sparks; 19. The matter before the Court is sentencing. PSI has been received and reviewed. For the offense of possession of explosives, a felony, Count I, the Court defers imposition of sentence for a period of three years. The defendant shall serve 30 days in the LCJ with credit for time served on Count I. The State indicates time suspended if Defendant attains his G.E.D. within six months. Attorney Steve Eschenbacher presents the certificate of G.E.D. to the Court. The Court deems the 30 day sentence as satisfied by Defendant obtaining G.E.D.
-State of Montana vs. Brian Keith Viles; 46. The matter before the Court is arraignment. Ready to enter plea, the Defendant pleads not guilty to the charges of driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony, Count I, operating a motor vehicle without liability insurance in effect - first offense, a misdemeanor, Count II, and driving a motor vehicle while privilege to do so is suspended or revoked, a misdemeanor, Count III. The plea is entered and the case will be set for trial. Defendant remains at liberty. The Court sets this matter for omnibus hearing on June 2 at 9 a.m.
-State of Montana vs. Eugene Heavyrunner; 60. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to the charge of partner or family member assault, third offense, a felony. The plea is entered and the case will be set for trial. Defendant remains at liberty. The Court sets this matter for omnibus hearing on June 2 at 9 a.m.
-State of Montana vs. Joshua Couture; 20. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to the charge of assault on a peace officer, a felony. The plea is entered and the case will be set for trial. Defendant remains in custody. The Court sets this matter for omnibus hearing on May 26 at 9 a.m.
