Lake County District Court, Judge McNeil presiding

*The following district court proceedings took place Nov. 10.

-State of Montana vs. Tanya McHatton; 39. The matter before the Court is sentencing on revocation. Ready for sentencing. For the offense of driving under the influence of alcohol or drugs, a felony, the Court commits the Defendant to the DOC for three years and would recommend Defendant be considered for Passages and pre-release. Previous conditions are re-imposed.

-State of Montana vs. Alan Kibler; 25. The matter before the Court is change of plea. Defendant admits committing the offense of partner or family member assault, a felony, Count I, and criminal endangerment, a felony, Count II. The Court makes its findings, accepts the plea and finds the Defendant guilty of the charge. PSI ordered. Sentencing is set for Jan. 5, 2011 at 9 a.m.

-State of Montana vs. Rhonda Lewis; 54. The matter before the Court is sentencing. PSI has been received and reviewed. For the offense of criminal possession of dangerous drugs, Count I, a felony, the Court defers imposition of sentence for a period of one year.

-State of Montana vs. Eugene Heavyrunner; 61. The matter before the Court is sentencing. For the offense of partner family member assault, a misdemeanor, the Court sentences the Defendant to the LCJ for one year all suspended but 15 days, with credit for three days. The Defendant shall serve the remainder of jail time within nine months on today’s date. If the Defendant successfully completes anger management and CD evaluation and follows all recommendations the remainder of the jail time is suspended.

Justice Court, Judge Wall presiding

*The following justice court proceedings took place Nov. 5-11.

-Snell, Kurtis W.; 20. Operating with alcohol concentration of 0.08 percent BAC or greater - second offense. Fined $600 and 180 days in jail with 175 days suspended. Littering - dumping/leaving any garbage/dead animal/refuse/debris. Fined $100. Fail to carry proof or exhibit/insurance in vehicle - first offense. Fined $250 and 10 days in jail with 10 days suspended.

-Hostman, Lee C.; 23. Driving without a valid driver’s license - expired more than 180 days. Fined $250 and 180 days in jail with 180 days suspended. Driving without a valid driver’s license - expired more than 180 days. Fined $300 and 180 days in jail with 180 days suspended.

-Racine, Kevin L.; 29. Improper passing in no passing zone. Fined $50. Fail to carry proof or exhibit insurance in vehicle - first offense. Fined $235.

Polson City Court, Judge Olson presiding

*The following city court proceedings took place Nov. 6-12.

-Sullivan, James D.; 26. Disorderly conduct. Fined $60.

-Caverly, Travis L.; 20. Fail to carry proof or exhibit insurance in vehicle - owner or operator - first offense. Fined $250.

-Symington, Henry A.; 40. Resisting arrest. Fined $200 and 10 days in jail with 10 days suspended.

-Eslick, Chad T.; 40. Following too closely - reasonable and prudent. Fined $50.

-Hostman, Lee C.; 23. Driving a motor vehicle while privilege to do so is suspended or revoked. Fined $350 and two days in jail. Owner permitting operation of vehicle without liability insurance - first offense. Fined $250.
