*The following district court proceedings took place Sept. 22.

-State of Montana vs. William John Kipp; 59. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to the charge of person required to register - procedure, a felony. The plea is entered and the case will be set for trial. Defendant remains in custody. Omnibus hearing is set for Oct. 13 at 9 a.m.

-State of Montana vs. Luke Patrick; 36. The matters before the Court are arraignment in DC-10-155 and hearing on merits in DC-99-40. Attorney Ben Anciaux indicates these matters can be addressed concurrently. Ready to enter plea, Defendant pleads not guilty to the charge of criminal possession of dangerous drugs, a felony, Count I. The plea is entered and the case will be set for trial. Defendant remains in custody on a $25,000 bond on the new charges, requests the bond be concurrent in both matters and that it be reduced to an amount the Defendant can afford, either an O/R release or $5,000 or $1,000. The State objects. The Court orders the reduction is denied. The Court clarifies that the bond is set at $25,000 in DC-10-155 is to be the only bond requested for both causes. Omnibus hearing in DC-10-155 and hearing on merits in DC-99-40 are set for Oct. 20 at 9 a.m.

-State of Montana vs. Vincent Curley; 30. The matter before the Court is change of plea. Defendant admits committing the amended offense of partner or family member assault, second offense, a misdemeanor, Count I. The Court makes its findings, accepts the plea and finds the Defendant guilty of the charge. The Court grants the State's motion to dismiss Count II. The parties are prepared for sentencing. The Court sentences the Defendant to the LCJ for one year with all suspended but 30 days. Defendant is to receive credit for time served of two days and two days in the Tribal jail if Defendant is able to prove it.

*The following district court proceedings took place Sept. 23.

-State of Montana vs. Cydrese Hendrickx; 22. The matter before the Court is sentencing on revocation. At the end of the criminal calendar, the Defendant is still not present. The State requests a warrant be issued. The Court advises that if the State prepares the warrant, the Court will sign.

-State of Montana vs. Harlan Vaska; 46. The matter before the Court is sentencing. For the offense of driving under the influence of alcohol or drugs, Count I, fourth or subsequent offense, a felony, the Court commits the Defendant to the MSP for 15 years with 10 years suspended and a $1,000 fine.

-State of Montana vs. Timothy Polly; 38. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to the charges of theft, a felony, Count I, or in the alternative theft, a felony. The plea is entered and the case will be set for trial. Attorney Nicole Ducheneaux request reduction in bail from $20,000 to a $500 cash bond or a $5,000 bail bond. The State objects. The Court denies bail reduction at this time and advises that the Defense shall have an opportunity at the next hearing to address the bail and that the Court would like to see the bail set in the amount of the value of the stolen vehicle. The Court also requests the Defendant obtain additional information concerning job possibilities in Kalispell. The Defendant remains in custody. The Court sets this matter for omnibus hearing on Oct. 7 at 9 a.m.

-State of Montana vs. Robert Templer; 40. The matter before the Court is omnibus hearing in DC-10-6 and DC-10-106. This matter resumes at the end of the criminal calendar with the Defendant not present. The State requests a warrant for arrest be issued. The Court advises the State of prepare a warrant of arrest and the Court will sign.

-State of Montana vs. David Langan; 28. The matter before the Court is change of plea. Defendant admits committing the offense of burglary, Count I, a felony, and theft, Count IV, a misdemeanor. The Court makes its findings, accepts the plea and finds the Defendant guilty of the charge. Attorney Ethan Lerman requests PSI and sentencing be set for Oct. 21 as this will be close to the expiration of the 90 days jail time the Defendant is set to serve. No objection by the State. Request granted by Court. PSI ordered. Sentencing is set for Oct. 21 at 9 a.m.

-State of Montana vs. Jessica Lynn Lozeau; 25. The matter before the Court is answer petition to revoke. Attorney Ben Anciaux indicates the Defendant has a current trial date of Dec. 6, 2010 in Judge McNeil's court and would request a continuance until those matters are resolved. The State objects. The Court sets adjudicatory hearing in this matter for Oct. 7. The Court enter general denial of all allegations on behalf of the Defendant. This matter is set for adjudicatory hearing on Oct. 7 at 9 a.m.

-Cordova, Isaac H.; 25. Driving under the influence of alcohol - second offense. Fined $600 and 180 days in jail with 166 suspended. Fleeing from or eluding peace officer. Fined $200 and 365 days in jail with 358 suspended.

-Ackermann, Arlene M.; 46. Operating with alcohol concentration of 0.08 percent BAC or greater - first offense. Fined $400 and 10 days in jail with 10 suspended. Driving without a valid driver's license - expired more than 180 days. Fined $200 and 180 days in jail with 180 suspended.

-Snyder, James D.; 19. Driving without a valid driver's license - expired less than 180 days. Fined $100.

-Kibler, Monika M.; 46. Careless driving. Fined $50. Operating without liability insurance in effect - first offense. Fined $250. Operating with expired registration - failure to reregister. Fined $50.

-Gonzalez, Jose A.; 19. Driving a motor vehicle while privilege to do so is suspended or revoked. Fined $250 and 180 days in jail with 178 suspended.

-Vanalstine, William D.; 54. Failure to carry proof or exhibit/insurance in vehicle - first offense. Fined $150.
