*The following district court proceeding took place Sept. 2.

-State of Montana vs. Jason O'Canna; 44. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to the charges of criminal possession with intent to distribute and criminal possession of dangerous drugs. The plea is entered and the case will be set for trial. The Defendant remains at liberty by posting of bail bond. The Court sets this matter for omnibus hearing on Oct. 21 at 9 a.m.

Lake County District Court, Judge McNeil presiding

*The following district court proceedings took place Sept. 1.

-State of Montana vs. Maureen Hunter; 53. The matter before the Court is sentencing. The Court commits the Defendant to the DOC for placement in an appropriate correctional facility for 13 months followed by a two year commitment to the DOC, all of which is suspended. Defendant is to receive credit for time served.

-State of Montana vs. Kyle Brown; 36. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to the charge of deliberate homicide, a felony. The plea is entered and the case will be set for trial. Defendant remains in custody. Prosecutor Mitch Young indicates the Defendant is in federal custody. Omnibus hearing is set for Sept. 29 at 9 a.m.

-State of Montana vs. Tashina Carpenter; 21. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to the charges of assault with a weapon, a felony, Count I, and aggravated assault, a felony, Count II. The plea is entered and the case will be set for trial. Defendant remains at liberty on bond posted. Omnibus hearing is set for Oct. 13 at 9 a.m.

-State of Montana vs. John Steele; 18. The matters before the Court are arraignment in DC-10-142 and omnibus hearing in DC-10-102. Ready to enter plea, Defendant pleads not guilty to the charge of criminal possession of dangerous drugs, a felony. The plea is entered and the case will be set for trial. Defendant remains in custody. Attorney Brian West asks to reserve bond hearing. So ordered. Omnibus hearing is set for Sept. 22 at 9 a.m. Mr. West requests to continue DC-10-102 until Sept. 22 also. No objections by the State.

-State of Montana vs. Rocky Armijo; 34. The matter before the Court is arraignment. Ready to enter plea, Defendant pleads not guilty to the charges of aggravated assault, a felony, Count I; criminal endangerment, a felony, Count II; and partner or family member assault, a felony, Count III. The plea is entered and the case will be set for trial. Defendant remains in custody. Bond has been set at $50,000 and the Defendant requests a reduction to $10,000. The State objects. The Court denies the Defendant's motion for reduction in bond. Omnibus hearing is set for Sept. 22 at 9 a.m.

-State of Montana vs. Sheldon Haynes; 21. These matter before the Court are change of plea. Defendant admits committing the offense of burglary, a felony, Count I, in DC-10-4, and to the offense of tampering with or fabricating physical evidence, a felony, in DC-10-93. The Court makes its findings, accepts the plea and finds the Defendant guilty of the charges. The Court grants the State's motion to dismiss Count II in DC-10-4. PSI is ordered. Sentencing is set for Oct. 6 at 9 a.m.

-State of Montana vs. Cody Stringer; 23. The matter before the Court is answer petition to revoke. Defendant will be making admissions. The Court finds the admissions are sufficient and the Defendant's suspended sentence is revoked. The parties are prepared for sentencing. The Court commits the Defendant to the DOC for three years with all suspended to run concurrent with the sentence in Lewis and Clark County.

*The following justice court proceedings took place Aug. 27-Sept. 2.

-Wilhelm, Jeffrey S.; 25. Fail to carry proof or exhibit/insurance in vehicle - third or subsequent offense. Fined $500 and 180 days in jail with 175 days suspended.

-Schiele, Kendra N.; 24. Fail to carry proof or exhibit insurance in vehicle - first offense. Fined $150.

-Brown, Evan H.; 76. Improper passing in no passing zone. Fined $50. Operating without liability insurance in effect - first offense. Fined $350 and 10 days in jail with eight days suspended. Provide proof of six months continuous insurance on Feb. 9, 2011 and jail waived.

-Benjamin, Walter J.; 52. Operating with alcohol concentration of 0.08 percent BAC or greater - first offense. Fined $400 and 10 days in jail with 10 suspended.

-McDonald, Marlin M.; 36. Operating a motorboat or vessel for towing without an observer. Fined $50.

-Bowen, Becca L.; 18. Following too closely - reasonable and prudent. Fined $50.

-Snyder, James D.; 19. Obstructing a peace officer or other public servant. Fined $100 and 180 days in jail with 180 suspended.
