Lake County District Court, Judge Christopher presiding*The following district court proceedings took place Dec. 1.

-State of Montana vs. Michael Mahseelah; the matter before the court is sentencing on revocation. For the offense of Assault on a Peace Officer, a Felony, Count I, the court commits the defendant to DOC for 10 years all suspended and for the offense of Assault a felony, the court commits the defendant to the DOC for 15 years with 10 suspended to run consecutive to Count I. The court recommended the defendant be screened for placement that will deal with her mental health rather than placement at the MWP.

-State of Montana vs. Janice Ness; the matter before the court is arraignment. Defendant pleads not guilty to the charges of criminal possession with intent to distribute, a felony, count I and tampering with or fabricating physical evidence, a felony, count II. The court sets this matter for omnibus hearing on Thursday, Jan. 12, 2012 at 9 a.m. with jury trial commencing on Monday, Feb. 27. 2012.

-State of Montana vs. Tiffany Jore; the matter before the court is arraignment. Defendant pleads not guilty to charges of criminal possession of dangerous drugs, a felony, count I and criminal possession of drug paraphernalia, a misdemeanor, count II. The court sets this matter for omnibus hearing on Thursday, Feb. 2, 2012 at 9 a.m. with jury trial commencing on Monday, March 12, 2012.

-State of Montana vs. Donna Lamere; the matter before the court is change of plea. Acknowledgement of Rights and Plea Agreement ordered filed. Defendant admits committing the amended offense of criminal possession with intent to distribute, a felony. The court makes its findings, accepts the plea and finds the defendant guilty of the charge.

-State of Montana vs. Lisa Francis, the matter before the court is change of plea. Acknowledgement of Rights and Plea agreement filed. Defendant admits to committing the lesser offense of criminal possession of dangerous drugs, a misdemeanor count I and criminal possession of dangerous drugs, count II, a felony. The court makes its findings, accepts the plea and finds the defendant guilty of the charge. PSI ordered. Sentencing is set for Thursday, Jan. 12, 2012 at 9 a.m.

-State of Montana vs. Kenneth Brien; the matter before the court is adjudicatory hearing. Counsel indicates the defendant will be making admissions to the report of violation. The court finds the state provided sufficient evidence to support the petition and revokes the defendant’s suspended sentence and deferred sentence. For the offense of sexual assault intercourse without consent, a felony, the court commits the defendant to the DOC for 13 years with 10 suspended and indicates the defendant is not eligible for parole until he completes Phase One of the sexual offender treatment program and would recommend defendant be screened for a DOC facility that can address the defendant’s alcohol violations as well as his sex offender treatment following by pre-release.

Lake County District Court, Judge McNeil presiding

*The follow district court proceedings took place Nov. 30.

-State of Montana vs. Arnold McDonald; the matter before the court is arraignment. Defendant pleads not guilty to the charges of assault with a weapon, a felony, count I, tampering with witnesses and informants, a felony, count II and tampering with or fabricating physical evidence, a felony, count III. The court sets this matter for omnibus hearing on Wednesday, Feb. 1, 2012 at 9 a.m. and jury trial is set for Monday, April 2, 2012 at 9 a.m.

-State of Montana vs. Keely Thomas McDonald, the matter before the court is hearing on merits. Counsel indicates the defendant will be making admissions to the report of violation. The court finds the admissions are sufficient and the defendant’s suspended sentence is revoked. The parties are prepared for sentencing. The court commits the defendant to MSP for fifteen years with five suspended. Defendant is to receive credit for time while in custody.

*The following justice court proceedings took place Nov. 25 and Dec. 1.

-Michelle Bartels; 42. Reckless driving – first offense. Fined $300 and 90 days in jail with 90 days suspended.

-Michael Erickson; 40. Partner or family member assault – second offense. Fined $500 and 365 days in jail with 355 days suspended.

-Robert Stotts; 42. Reckless driving – first offense. Fined $300 and 90 days in jail with 89 days suspended.

-Brittany McGillivray; 28. Reckless driving – first offense. Fined $300 and 90 days in jail with 90 days suspended.

-Michael Lawlor; 23. Improper passing in a no-passing zone. Fined $50.

-Anthony Moschetti; 29. Reckless driving – first offense. Fined $300 and 90 days in jail with 89 days suspended.

-Arnold Clark; 59. Surreptitious visual observation or recordation – first offense. Fined $100 and 180 days in jail with 180 days suspended. Sexual assault. Fined $100 and 180 days in jail with 180 days suspended.

-Larry Williams; 49. Disorderly conduct. Fined $50 and 10 days in jail with 9 days suspended.

*The following justice court proceedings took place Nov. 18-26.

-Melissa Nichole Morgan; 21. Driving without a valid driver’s license. Fined $50.

-Larry Dale Mickelson; 64. ROW Violation, Failure to yield to approaching traffic when making left turn. Fined $50.

-Dennis Patrick Gates; 42. Careless driving. Fined $50.

-Justin Wayne Crandall; 42. Violation of a protective orger - first offense. Fined $200 and 2 days in jail.
