Lake County District Court, Judge Christopher presiding

*The follow District Court roceedings took place on Dec. 15.

-State of Montana vs. Howard Peone; the matter before the court is sentencing. For the offense of assault on a peace officer, a felony, the court commits the defendant to the DOC for a term of 10 years with five years suspended. The court recommends defendant be considered for connection corrections followed by pre-release. In addition the defendant is to pay for the cost of the jury, prosecution and public defender, the court also indicates that since the defendant is indignant non-payment on costs will not be a condition for revocation. Defendant’s counsel indicates that he will be filing a notice of appeal on the jury’s verdict.

-State of Montana vs. Emery John Smith II; the matter before the court is adjudicatory hearing. Counsel indicates the defendant will be making admissions to the report of violation. Defendant is sworn. The court reads revocation acknowledgment of rights to the defendant. The court finds that the admissions are sufficient and the defendant’s suspended sentence is revoked. Ready for sentencing the court commits defendant to DOC for three years with one year suspended. The court recommends defendent be considered for connection corrections or watch program and pre-release after he has completed a chemical dependency program. Defendant is to receive credit for time while in custody.

-State of Montana vs. Christopher Morigeau; the matter before the court is arraignment. Defendant pleads Not Guilty to the charge of Partner or Family Member Assault, third offense, a felony. The court sets this matter for omnibus hearing on Thursday, Feb. 9, 2012 at 9 a.m. and jury trial is set for Monday, March 26, 2012 at 9 a.m.

*The following Justice Court proceedings took place Dec. 9-15.

-Rodney Mckenzie; 20. Criminal contempt. Fined $100 and 180 days in jail with 179 suspended.

-Jonathan Snyder; 31. Partner or family member assault - first offense. Fined $300 and 365 days in jail with 364 days suspended.

-Arla Azure; 76. Operating with alcohol concentration of 0.08 percent BAC or greater - first offense. Deferred imposition of sentence and fined $400 and 10 days in jail with 10 suspended.

-Colby Wolfenden; 25. Driving under the influence of alcohol - second offense. Fined $600 and 180 days in jail with 173 suspended.

-Anthony Brodie; 22. Operating with alcohol concentration of 0.08 percent BAC or greater - first offense. Deferred imposition of sentence and fined $400 and 180 days in jail with 180 days suspended.

-Zachery Bates; 23. Driving under the influence of alcohol - first offense. Fined $400 and 180 days in jail with 179 days suspended. Failure to carry proof or exhibit/insurance in vehicle - owner and operator - first offense. Fined $150.

-Joshua Jenson; 31. Failure to carry proof or exhibit insurance in vehicle - owner or operator - first offense. Fined $150.

-Marc Mulcahy; 45. Careless driving. Fined $50.

Polson City Court, Judge Olson presiding

*The following Polson City Court proceeding took place Dec. 10-16.

-Pamela Tibbetts; 43. Driving without a valid driver’s license. Fined $50.

The following are corrections from the Dec. 15 court records:

-Anna Olson Starkel’s Jan. 31, 2009 charge of endangering welfare of a child was dismissed. Her fine of $300 and sentence of one day home time was served in March 2009.

-Karla Hawkins’ Dec. 3, 2010 charge of driving under the influence of alcohol was amended last week to reckless driving.

-John Louis Cross’ Dec. 9, 2011 charge of driving under the influence of alcohol was amended last week to reckless driving.

Booked into county jail

*The following individuals were booked into county jail between Dec. 12-19. All are innocent until proven guilty in a court of law.

- Shane Romero; 38. Arrested on-site for PFMA - serious bodily injury, a felony. Obstructing a peace officer, a misdemeanor and disorderly conduct, a misdemeanor.

- Dustin Walker; 28. Arrested on-site for possession of drug paraphernalia, a misdemeanor. An out of county warrant, a misdemeanor, and criminal contempt, a misdemeanor.

-Jerry Hoffman; 27. Arrested on a warrant for FTPC, FTFCO, FTA, a felony.

-Colby Wolfenden; 25. Arrested on a warrant.
