Lake County District Court, Judge McNeil presiding
*The following district court proceedings took place April 11.
-State of Montana vs. Kathy Stocking; the matter before the court is answer petition to revoke. Counsel indicates defendant intends to make admissions today. The court finds the admissions are sufficient and the defendant’s deferred sentence is revoked. The parties are prepared for sentencing. The court again defers imposition of sentence for five years. The conditions originally imposed are re-imposed with the additional condition that defendant pay restitution of $300 per month commencing July 15, 2012 until paid in full. Defendant is to receive credit for time in custody.
-State of Montana vs. Randolph Nigg; the matter before the court is a change of plea. Acknowledgement of Rights and Plea Agreement is ordered filed. The court has reviewed and accepts the plea agreement. The court advises counsel that the possible punishment under the PFON contains a minimum of five years in the MSP. Defendant is sworn and understands the rights he is waiving. Defendant admits committing the offense of Driving Under the Influence of Alcohol or Drugs, fourth or subsequent offense, a felony. The court makes its findings, accepts the plea and finds the defendant guilty of the charge. Sentencing is set for Wednesday, May 16 at 9 a.m.
-State of Montana vs. Eric Baszler; the matter before the court is sentencing. Recommendations by counsel pursuant to plea agreement. The court defers sentence for six years. As conditions restitution is ordered in the amount of $27,359.34 to the Flathead Lake Brewery.
-State of Montana vs. Shane Romero; the matter before the court is sentencing. Recommendations by counsel pursuant to plea agreement. The court commits defendant to DOC for three years, all of which are suspended except 50 days.

*The following district court proceedings took place April 12.
-State of Montana vs. Roger Pablo; the matter before the court is an omnibus hearing. Acknowledgement of Rights and Plea Agreement ordered filed. The court has reviewed and accepts the plea agreement. Defendant admits committing the offense of Criminal Possession of Dangerous Drugs, a felony, Count I. The court makes its findings, accepts the plea and finds the defendant guilty of the charge. Sentencing is set for Thursday, May 10 at 9 a.m.
-State of Montana vs. Marvin Gardipe; the matter before the court is arraignment. Defendant pleads Not Guilty to the charges of Driving Under the Influence of Alcohol or Drugs. The plea is entered and the case will be set for trial. The Defendant remains at liberty. The court sets this matter for omnibus hearing on Thursday, June 14 at 9 a.m. with a jury trial commencing on Monday, July 23 at 9 a.m.
-State of Montana vs. Robert Crawford; the matter before the court is arraignment. Defendant pleads Not Guilty to the charges of Criminal Possession with the Intent to Distribute, a Felony. The plea is entered and the case will be set for trial. The court sets this matter for omnibus hearing on Thursday, May 24 at 9 a.m. with a jury trial commencing on Monday, July 9 at 9 a.m.
-State of Montana vs. Jeremy Rice; the matter before the court is arraignment. Defendant pleads Not Guilty to the charges of Threats and Improper Influence in Official and Political Matters, felonies, Count I & II and Assault with Bodily Fluid, misdemeanors, Counts III, IV, V. The plea is entered and the case will be set for trial. The court sets this matter for omnibus hearing on Thursday, June 14 at 9 a.m. with a jury trial commencing on Monday, July 23 at 9 a.m.
-State of Montana vs. John Morrow; the matter before the court is an adjudicatory hearing. Counsel indicates that Defendant will be making admissions. The court finds the state provided sufficient evidence to support the petition and revokes the Defendant’s suspended sentence. For the offense of Theft, a Felony, the court commits the Defendant to DOC for eight years with four years suspended.
-State of Montana vs. Trevor Scott; the matter before the court is sentencing. For the offense of Forgery, a common scheme, III, a felony, the court defers imposition of sentence for a period of six years.

-Manuel Figueroa; 58. Failure to carry proof or exhibit insurance in vehicle - owner or operator - third or subsequent offense. Fined $450.
-Michael Robbins; 34. Speeding - exceeding restricted/special zone speed limit established by department. Fined $50. Driving without a valid driver’s license. Fined $250 and 180 days in jail with 180 days suspended.
-Tammy Whisman; 42. Operating with alcohol concentration of 0.08 percent BAC or greater - first offense. Fined $400 and 10 days in jail with 10 days suspended.
-Richard King; 56. Failure to notify owner after accident resulting in damage to prop/fixtures along highway. Fined $150.
-Randy Schock; 29. Driving a motor vehicle while privilege to do so is suspended or revoked. Fined $350 and 180 days in jail with 175 days suspended. If proof of valid driver’s license is provided by May 1, jail time is reduced by three days. Owner permitting operation of vehicle without liability insurance - third or subsequent offense. Fined $450 and 180 days in jail with 175 days suspended. If proof of insurance is provided by May 1 and there’s six months continuous coverage, than jail reduced by three days.
-Tye Herreid; 27. Operating without liability insurance in effect - second offense. Fined $350 and 10 days in jail with eight suspended. If proof of insurance is provided by April 6 and there’s six months continuous coverage then jail time is waived.
-Tony Salmonsen; 50. Improper passing in a no-passing zone. Fined $100 and 180 days in jail with 180 days suspended.
-Myles Metzger; 19. Careless driving. Fined $50.
