Lake County District Court,  Judge McNeil presiding

*The following district court cases took place on Dec. 5.

- State of Montana vs. Randall Stevens. The matter before the court is sentencing. The court defers imposition of sentence for (3) years. Defendant is to serve 30 days in Lake County Jail. Defendant is ordered to pay restitution in the amount of $295 to the victim of the offense.  

- State of Montana vs. Phyllis Fairbanks. This matter before the court for arraignment. Defendant pleads not guilty to two charges of criminal possession of dangerous drugs, both felonies. The court sets this matter for Omnibus hearing on Wednesday, Jan. 30, 2013 at 9:00 a.m. with a jury trial commencing on Monday, April 1, 2013 at 9:00 a.m.

- State of Montana vs. Doreen Johnston-Knoll. The matter before the court is sentencing for a felony count of theft the court defers imposition of sentence for three years. Restitution has been paid in the amount of $2,882.72 to the victims of the offense. A ten day jail sentence is imposed, but suspended on the condition there be no violations.

*The following district court cases took place on Dec. 6.

- State of Montana vs. Marvin Gardipe. The matter before the court is change of plea. Gardipe admits to committing the amended offense of driving under the influence of alcohol or drugs, a felony. The court accepts the plea and finds Gardipe guilty of the charge. Sentencing is set for Thursday, March 14, 2013 at 9:00 a.m.

- State of Montana vs. Lionel Shepherd. The matter before the court is change of plea. Shepherd admits to committing the  offense of driving under the influence of alcohol or drugs, a felony. The court accepts the plea and finds Shepherd guilty of the charge. Sentencing is set for Thursday, Jan. 31, 2013 at 9:00 a.m.

- State of Montana vs. Shane Johnson. The matter before the court is sentencing. The court commits Johnson to the Department of Corrections for 2 years with all suspended for the offense of issuing a bad check, common scheme, a felony. Johnson was found guilty of issuing 83 bad checks to businesses is Lake County. Sentence is deferred on the conditions in the plea agreement and restitution in the amount of $2,884.70.

- State of Montana vs. Wesley Charlo. The matter before the court is petition to revoke. Charlo received a suspended sentence on the charge of failure to register as a violent offender, a felony, in Oct. 2011. Charlo admitted on Dec. 6, 2012 to violating the following probation agreements, failure to provide his probation officer with  current address, failure to search for employment, failure to report to his probation officer in person twice a month, drug and alcohol use, failure to participate in counseling or treatment. His suspended sentence is revoked and Charlo is committed to the Department of Corrections for 3 years with none suspended. Charlo is to receive credit for time while incarcerated.

*The following justice court proceedings took place from Nov. 30 - Dec. 6.

- Jeremy Combs; 29. Reckless driving -first offense, a misdemeanor. 90 days in jail with 83 suspended. Fined $300.

- Barret Sargent; 18. Operating with alcohol concentration of 0.02% BAC under 21 years of age - first offense, a misdemeanor. Fined $450.

- Ryan Randles; 31. Driving under the influence of alcohol-second offense, a misdemeanor. 360 days in jail with 346 days suspended. Fined $600. Failure to carry proof or exhibit insurance in vehicle-owner or operator-first offense, a misdemeanor. Fined $250.

- Tina Davis; 43. Driving without a valid driver’s license, a misdemeanor. Fined $50.

- Laurence Mikesell; 72. Exceeding the max gross weight allowed any group of axles (bridge formula), a misdemeanor. Fined $225.

- Wade Noyes; 36. Failure to carry proof or exhibit insurance in vehicle-owner or operator-first offense, a misdemeanor. Fined $250. Failure to notify owner after accident resulting in damage to prop fixtures along highway, a misdemeanor. Fined $250.

- William Pederson; 39. Operating without liability insurance in effect-first offense, a misdemeanor. 5 days in jail with 5 suspended. Fined $250.

- Caitlyn Brigham-Sias; 21. Failure to carry or exhibit insurance in vehicle-owner or operator-second offense, a misdemeanor. 10 days in jail with 10 suspended. Fined $350.

-Ralph Mccoy; 45. Partner or family member assault-first offense, a misdemeanor. 360 days in jail with 356 days suspended. Fined $300.

-Gregory Fryberger; 54. Operate a vehicle which has not been properly registered, a misdemeanor. Fined $50.

- Alfred Salway; 80. Operating with expired registration-failed to reregister, a misdemeanor. Fined $50.

Polson City Court, Judge Olson presiding

*The following city court proceedings took place Dec. 1-8.

-Marvin Castanuela;Driving a motor vehicle while privelege to do so is suspended or revoked, a misdemeanor. 2 days in jail. Fined $250. Failure to have child under 6 years old and less than 60 lbs. properly restrained, a misdemeanor. Seatbelt violation, a misdemeanor. Fined $20.

Booked into county jail

*The following people were booked into the county jail from Dec.7-9, but in most cases have not had a chance to enter a plea. They are innocent until proven guilty in a court of law.

- Marvin Castanuela; 37. Arrested on a warrant for criminal contempt, a misdemeanor.

- Christopher Courville; 31. Arrested on a warrant for a probation violation, a felony.

- Brian Johnston; 38. Arrested on-site.

- Francis Aimsback; 30.  Arrested on-site for a parole violation, a felony.

- Stephanie Bean; 30.  Arrested on-site for assault on a peace office, a felony.

Released from county jail

- Vincent Swan; 30. Arrested on a warrant for criminal contempt, a misdemeanor.

- Rebecca Coffman; 36. Arrested on a warrant. For criminal contempt, a misdemeanor.

- Kylie Reum; 23.  Arrested on-site for DUI drugs or alcohol, a misdemeanor.
