Lake County District Court, Judge Christopher presiding
*The following district court cases took place on Dec. 13.
-State of Montana vs. Jason David. This matter came before the court for arraignment. Defendant pleads not guilty to the charges of sexual intercourse without consent, counts I, II, and III, felonies; attempt, count IV, a felony; aggravated assault, a felony, count V; and aggravated kidnapping, count VI, a felony. The court sets this matter for Omnibus hearing on Wednesday, January 31, 2013 at 9:00 a.m. with a jury trial commencing on Monday, March 11, 2013 at 9:00 a.m. Bond is currently set at $50,000.
-State of Montana vs. Ben Hoffman. This matter came before the court to answer petition to revoke. Hoffman is sentenced for eight years, all suspended to run consecutive to previous sentences. Hoffman received a suspended sentence for the offense of issuing a bad check, a felony, in Nov. 2010. In Sept. 2012, the court was petitioned to revoke the suspended sentence on the grounds that the defendant failed to comply with all rules of probation imposed by the Department of Corrections. Defendant is to receive credit for time served while in custody.
-State of Montana vs. Magic Johnson. This matter came before the court for change of plea. Defendant admits committing the amended offense of forgery, a misdemeanor, count I. The court accepts the plea and finds the defendant guilty of the charge. The court sentences the defendant for six months all suspended on the condition that the defendant serve ten days in the LCJ within ninety days of sentencing, pay all fines and surcharges, and restitution to the victim of the offense, First Citizen’s Bank. According to court documents, in Aug. 2012, Johnson “knowingly made or altered a check in the amount of $2,400” with purpose to defraud another person.

-Adam Schwarz, 30. Speeding on non-interstate, exceeding day limit of 70 mph, a misdemeanor. Fined $40.
-Michael Garcia, 22. Turning when unsafe to do so, a misdemeanor. Fined $50. Failure to carry proof or exhibit insurance in vehicle, a misdemeanor. 5 days in jail with 5 suspended. Fined $250.
-Leonard Stanley, 50. Resident operating with foreign license and registration, a misdemeanor. Fined $50.
-Tima Brown, 52. Operating with alcohol concentration of 0.08% BAC or greater, first offense, a misdemeanor. 180 days in jail with 180 suspended. Fined $400.
-Erica Vigil, 22. Disorderly conduct, a misdemeanor. Fined $100.
-Rud Knudsen, 58. Seatbelt violation, a misdemeanor. Fined $20.
-Joseph Trujillo, 20. Speeding interstate urban, exceeding night limit of 65 mph, a misdemeanor. Fined $20.
-Alexandria Clausen, 18. Speeding on non-interstate, exceeding day limit of 70 mph, a misdemeanor. Fined $20.
-Dennis Duty, 59. Speeding, exceeding restricted zone speed limit, a misdemeanor. Fined $20.
-Megan Jo Mclean, 25. Speeding, exceeding restricted zone speed limit, a misdemeanor. Fined $50.
-Hannah Knudsen, 28. Seatbelt violation, a misdemeanor. Fined $20.
-Geoffrey Kellman, 46. Speeding on non-interstate, exceeding day limit of 70 mph, a misdemeanor. Fined $20.
-Wayne Kellberg, 39. Driving a motor vehicle while privilege to do so is revoked, a misdemeanor. 180 days in jail with 178 suspended. Fined $250.
