Lake County District Court, Judge McNeil presiding

*The following district court proceedings took place Feb. 1.

-State of Montana vs. John Ducharme; the matter before the court is sentencing. The court commits defendant to Department of Corrections for 13 months to be placed in an appropriate correctional facility following which defendant will be placed on a suspended sentence with the DOC for two years.

-State of Montana vs. Dustin Walker; the matter before the court is sentencing. Recommendations pursuant to plea agreement, council explains defendant’s reason to be released rather than a Department of Corrections commitment. The court commits defendant to DOC for two years no part of which is suspended.

-State of Montana vs. Eric Baszler; the matter before the court is arraignment. Defendant pleads not guilty to the charge of theft, a felony. Defendant remains at liberty. The court sets this matter for omnibus hearing on Wednesday, March 28 at 9 a.m. with a jury trial commencing on Monday, June 4 at 9 a.m.

-State of Montana vs. Billie Jo Healy; the matter before the court is arraignment. Defendant pleads not guilty to the charges of driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony, count I. Defendant remains at liberty. The court sets this matter for omnibus hearing on Wednesday, March 28 at 9 a.m. with a jury trial commencing on Monday, June 4 at 9 a.m.

-State of Montana vs. Jack Whaling; the matter before the court is change of plea. Acknowledgement of Rights and Plea Agreement is ordered filed. The court has reviewed and accepts the plea agreement. Defendant admits committing the offense of Attempt (Theft), a felony. The court makes its findings accepts the plea and finds the defendant guilty of the charge. Sentencing is set for Wednesday, March 7 at 9 a.m.

-State of Montana vs. Shane Romero; the matter before the court is change of plea. Acknowledgement of Rights and Plea Agreement is ordered filed. The court has reviewed and accepts the plea agreement. Defendant admits to committing the offense of Partner or Family Member Assault, a felony. The court makes its findings, accepts the plea and finds the defendant guilty of the charge. Sentencing is set for Wednesday, March 7 at 9 a.m.

-State of Montana vs. Donna Lamere; the matter before the court is sentencing. Recommendations pursuant to the plea agreement. The court commits the defendant to Department of Corrections for 10 years with six suspended.

-State of Montana vs. Janeva Lee Albert; the matter before the court is change of plea. Acknowledgement of Rights and Plea Agreement ordered filed. The court has reviewed and accepts the plea agreement. Defendant admits committing the offense of unauthorized use of a motor vehicle, a misdemeanor. The court makes its findings accepts the plea and finds the defendant guilty of the charge. The court grants the state’s motion to dismiss count I. Parties are prepared for sentencing. Recommendations pursuant to plea agreement. The court commits the defendant to LCJ for six months with all time suspended.

-State of Montana vs. Edwin Onesalt, Jr. The matter before the court is arraignment. Defendant pleads not guilty to the charge of driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony. The court sets this matter for omnibus hearing on Thursday, March 8 at 9 a.m. with a jury trial commencing on Monday, May 7 at 9 a.m.

-State of Montana vs. David A. Boucher, Jr. The matter before the court is change of plea. Council explains and will be dismissing Justice Court case according to the plea agreement and wishes to file an amended plea agreement. Defendant pleads guilty to the charge of burglary, a felony, Count I. Acknowledgment of Rights and Plea Agreement is ordered filed in both cases. The court has reviewed and accepts the plea agreement. Defendant admits committing the offense of criminal possession of dangerous drugs, Count I, a felony and the offense of burglary, count II, a felony. Sentencing in both matters is set for Thursday, March 8 at 9 a.m.
