Lake County District Court, Judge McNeil presiding

*The following District Court proceedings took place on Dec. 21.

-State of Montana vs. Michael Morigeau; the matter before the court is sentencing on revocation. The court sentences defendant to MSP for three years. Defendant is to receive credit for time while in custody. In the event the Defendant is released earlier, the court recommends that DOC impose the conditions originally inposed.

-State of Montana vs. Dustin Walker; the matter before the court is arraignment. Defendant pleads not guilty to the charge of criminal possession of dangerous drugs, a felony. Counsel indicates the parties have been discussing a plea agreement and asks to move this matter to this afternoon. The parties ask for a change of plea hearing in the afternoon. Acknowledgement of Rights and Plea Agreement is ordered filed. Defendant admits to commiting the offense of criminal possession of dangerous drugs, a felony. The court makes its findings, accepts the plea and finds the defendant guilty of the charge. Sentencing is set for Wednesday, Jan. 25, 2012 at 9 a.m.

-State of Montana vs. John Ducharme; the matter before the court is change of plea. Acknowledgement of Rights and Plea Agreement ordered filed. Defendant admits to committing the offense of Driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony. The court makes its findings, accepts the plea and finds the defendant guilty of the charge. Sentencing is set for Wednesday, Jan. 25, 2012 at 9 a.m.

*The following district court proceedings took place on Dec. 22.

-State of Montana vs. Kenny Oldperson; the matter before the court is revocation hearing. Ready for sentencing. For the offense of criminal endangerment, a felony, Count II, the court commits the Defendant to MSP for three years and for the offense of Endangering the Welfare of Children, a misdemeanor, Count III, the court commits the defendant to the LCJ for six months with two months suspended to run consecutive to the Missoula County charge.

-State of Montana vs. William Pounds; the matter before the court is omnibus hearing. Acknowledgement of Rights and Plea Agreement ordered filed. The court has reviewed and accepts the plea agreement. Defendant admits committing the offense of Criminal Endangerment, a felony, Count III. The state dismisses Assault with Weapon, felonies, Count I and II. The court makes its findings and finds the defendant guilty of the charge. Sentencing is set for Thursday, Jan. 12, 2012 at 9 a.m.

-Paul Stokes; 39. Operating without liability insurance in effect - first offense. Fined $150 and 10 days in jail with 10 days suspended. Driving under the influence of alcohol - first offense. Fined $300 and 90 days in jail with 85 days suspended.

-Lawson Sanders; 24. Driving under the influence of alcohol - first offense. Fined $500 and 180 days in jail with 177 days suspended.

-Sabrina McCafferty; 25. Failure to carry proof or exhibit insurance in vehicle - first offense. Fined $150 and 10 days in jail with 10 days suspended. Driving under the influence of alcohol - second offense. Operating with alcohol concentration of 0.08 percent BAC or greater - second offense. Fined $600 and 30 days in jail with 25 days suspended.

-Sean Malatare; 20. Possessing intoxicating substances while under the age of 21 (over the age of 18) - first offense. Fined $100.

-John Tuttle; 62. Speeding - exceeding restricted special zone speed limit established by department. Fined $100. Obstructing a police officer or other public servant. Fined $300 and 180 days in jail with 177 days suspended. Driving under the influence of alcohol - first offense. Fined $100.

-Bill Sayles; 50. Careless Driving. Fined $50.

-Alexander Graves; 26. Driving a motor vehicle while privilege to do so is suspended or revoked. Driving without a valid driver’s license. Fined $250.

-Jesper Salmelin; 31. Operating with expired registration - failure to reregister. Fined $100.

-Jeanne Courville; 54. Driving a motor vehicle while privilege to do so is suspended or revoked. Fined $250 and 180 days in jail with 178 suspended. Owner permitting operation of vehicle without liability insurance - first offense. Fined $150. Operating with expired registration - failure to reregister. Fined $100.

-Joshua Ray; 26. Driving under the influence of any drug - first offense. Careless driving. Fined $100. Operating without liability insurance in effect - second offense. Fined $350.

-Yvonne Mcleod; 23. Owner permitting operation of vehicle without liability insurance - first offense. Fined $150.

-Jesse Hosler; 22. Reckless driving - second or subsequent offense. Careless driving. Fined $100. Operating without liability insurance in effect - second offense. Fined $350 and 10 days in jail with eight days suspended.

-Isabelle Kuhblank; 21. Failure to carry proof or exhibit insurance in vehicle - owner or operator - first offense. Fined $150.

-Jeryn Hendricks; 26. Unlawful use of vehicle while hunting - drive off established road. Fined $100.

-Ronald Bader; 65. Speeding - Operating with expired registration - failure to reregister. Fined $50.
