Polson man arraigned for sex crime

POLSON — A 49-year-old Polson man was arraigned on charges of solicitation and sexual acts on a 21-year-old woman and pleaded not guilty in Lake County District Court on Thursday. Nathan Whitefountain faces up to 100 years in jail and fines of $100,000 after he allegedly asked the victim for sex and performed a sex act on her without her permission.

According to court documents, in November of last year, a 21-year-old female called police and reported that she had been assaulted. She had been sleeping in a bed at Whitefountain’s residence and awoke to find him sitting next to her on the floor.

The affidavit said that Whitefountain penetrated her with his fingers, and she pulled away from him. At that point, he got off the floor and sat on the bed next to her, asking for what she interpreted as oral sex. The victim told Whitefountain to leave her alone and left the residence.

The victim also presented text messages to authorities, the court affidavit said, that were from Whitefountain’s ex-girlfriend. One of the texts read “Aww I’m sorry he said he is sorry too.” Another text said “he said he raped your ***** that is what he remember.”

When police arrested and questioned Whitefountain, he chose not to answer questions. When told he would be charged for the sexual acts, he said “Cool. Cool, I understand.”

An omnibus hearing is set for March 28 at 9 a.m. and a jury trial is set for June 4 at 9 a.m.
