Lake County District Court, Judge McNeil presiding

*The following district court proceedings took place July, 18, 2012.

-State of Montana vs. Brian Mitchell. The matter before the court is for hearing on merits. Defendant admits to charges that he violated his probation agreement and the defendant’s deferred sentence is revoked. The court commits the defendant to DOC for ten years with five years suspended. 

-State of Montana vs. Byron Tenas. The matter before the court is for hearing on merits. Defendant admits to charges that he violated his probation agreement and the defendant’s deferred sentence is revoked. The court commits the defendant to DOC for fifteen years with five years suspended. 

-State of Montana vs. Bryce Parker. The matter before the court is change of plea. Defendant admits to the offenses of criminal endangerment, a felony and driving under the influence of alcohol or drugs, a misdemeanor. Sentencing is set for Wednesday, Aug. 22, 2012 at 9 a.m.

-State of Montana vs. Marcus Padilla. The matter before the court is arraignment. Defendant pleads not guilty to the charges of assault with a weapon, a felony; aggravated assault, a felony; partner/family member assault, a misdemeanor; and unlawful restraint, a misdemeanor. Omnibus hearing is set for Wednesday, Sept. 12, 2012 at 9 a.m. with a jury trail commencing on Monday, Dec. 3, 2012 at 9 a.m. 

-State of Montana vs. Michael Bettencourt. The matter before the court is arraignment. Defendant pleads not guilty to the charge of threats and other improper influence in official and political matters, a felony.  Omnibus hearing is set for Wednesday, Sept. 12, 2012 at 9 a.m. with a jury trial commencing on Monday, Dec. 3, 2012 at 9 a.m. 

-State of Montana vs. Chase Kuntz. The matter before the court is arraignment. Defendant pleads not guilty to the charge of arson, a felony. Omnibus hearing is set for Wednesday, Sept. 12, 2012 at 9 a.m. with a jury trial commencing on Monday, Dec. 3, 2012 at 9 a .m.

-State of Montana vs. Ron Rorvik. The matter before the court is arraignment. Defendant pleads not guilty to the charge of partner or family member assault, a misdemeanor. Omnibus hearing is set for Wednesday, Sept. 12, 2012 at 9 a.m. with a jury trial commencing on Monday, Dec. 3, 2012 at 9 a .m.

-State of Montana vs. Tiffany Cutfinger. The matter before the court is sentencing. The court commits the defendant to DOC for seven years with four years suspended. 

-State of Montana vs. Alan L.Kibler. The matter before the court is for hearing of merits. Defendant admits to charges that he violated his probation agreement and the defendant’s deferred sentence is revoked. The court commits the defendant to DOC for eight years with three years suspended.

 

Lake County District Court, Judge Christopher presiding

*The following district court proceedings took place July 19, 2012.

- State of Montana vs. Joseph Cahoon. The matter before the court is petition to revoke. Defendant is ready for sentencing  for the offense of criminal endangerment, a felony. The court commits the defendant to DOC for three years and recommends inpatient treatment. 

-State of Montana vs. Jerry  Dickson. The matter before the court is sentencing. For the offense of criminal possession with intent to distribute, a felony.  The court commits the defendant to LCJ for a term of 30 days, all suspended.  Jail sentence may be satisfied if the defendant enters and successfully completes an inpatient chemical dependency treatment program.

-State of Montana vs. Robert J. Long. The matter before the court is change of plea. Defendant admits to driving under the influence of alcohol or drugs, a felony.  Sentencing is set for Thursday, Nov. 29, 2012 at 9 a.m.

-State of Montana vs. Rebecca Gunhammer. The matter before the court is sentencing. For the offense of assault on a peace officer or judicial officer, count I, a felony. The court commits the defendant to the MWP for a term of ten years, with all suspended to run consecutive.

*The following justice court proceedings took place July 16-21, 2012.

- Elisabeth Moser; 46. Driving under the influence of alcohol-first offense, misdemeanor. Fined $400 and 180 days in jail with 180 days suspended. 

- Bradley Craig; 54. Obstructing a peace officer or other public servant, misdemeanor. Fined $150 and 180 days in jail with 178 days suspended and two days credited.

- Miles Bieber; 20. Possessing intoxicating substances while under the age of 21-over the age 18-2nd offense, misdemeanor. Fined $200. 

Ronan City Court, Judge Bartels Presiding

*The following city court proceedings took place July 17-24, 2012.

- Alicia Talamantes; 22. Operating a motor vehicle while license is suspended or revoked, misdemeanor. Fined $250, sentenced to 180 days in jail with 178 suspended. 

- Manuel Figueroa; 58. Operating a motor vehicle without insurance, third offense - misdemeanor. Transferred to Tribal Court.

- Andrew Frissel; 51. Failure to carry proof or exhibit insurance in vehicle, misdemeanor.

-Jonathan Weber; 20. Operating a motor vehicle without insurance, misdemeanor. Fined $250, sentenced to ten days in  jail with eight suspended.
