District Court, Judge Manley presiding

*The following took place on Nov. 27.

-Misty Whitworth, of Pablo, appeared in court for arraignment and a change of plea, and admitted to committing felony offenses of criminal child endangerment (two counts) and criminal possession of dangerous drugs. Sentencing in both matters is set for Jan. 8.

The charges stem from an incident on Nov. 14, when Whitworth was involved in a single-vehicle accident and appeared to be under the influence, according to court documents.

The affidavit states that Whitworth admitted to the responding deputy that she had been out partying the previous night and had used marijuana, oxycodone, methadone, and methamphetamine. She also said that she had dropped her two children off at Pablo Elementary School immediately preceding the car accident.

Records also indicate that Whitworth is currently on felony probation for forging checks to buy drugs. A warrant had been issued for her arrest after her “failure to appear for court dates.”

-Trevor Gardipe, 17, came before the court for a change of plea and admitted to committing a felony offense of burglary, count I. The court dismissed counts II through IV after a motion by the state. Sentencing is set for Jan. 15.

An affidavit in Gardipe’s file reflects that on Aug. 31, Gardipe allegedly broke into the Pieceful Place Smoke Shop in Polson and stole “most of” the store’s merchandise.

Witnesses reportedly identified Gardipe as one of two people to commit the burglary, while the store’s owner also received texts and phone calls that implicated Gardipe in the wake of the incident.

-Vincent Burrafato, 38, of Pablo, reversed a plea and admitted to a felony DUI charge. Burrafato will be sentenced on Jan. 8.

Court documents state that Burrafato’s most recent DUI occurred on Oct. 1, when he was found “slumped over in the driver’s seat and drooling” in a vehicle at the intersection of Skyline Drive and Caffery Road in Polson. Burrafato fought with the arresting officers and kicked at windows after being placed in a patrol vehicle.

-Marco Houle came before the court for a change of plea and admitted to the amended misdemeanor offense of sexual assault.

The court proceeded to sentencing and gave Houle six months, with all suspended for a term of one year. Houle will receive credit for time served while in custody.

Court documents indicate that on June 26, after consuming some drinks at his Polson residence, Houle allegedly initiated non-consensual sex with a victim who was also his cousin.

An exam on the victim found medical evidence consistent with her claims.

-Marc Friscia, 25, of Polson, appeared before the court for adjudicatory hearing related to two cases that were handled concurrently. The court revoked Friscia’s suspended sentence after his attorney expressed willingness “to admit some of the allegation in the petition to revoke.”

Friscia’s alleged probation violations included failure to appear in court in Spokane, Wash. for unlawful possession of firearm charges, obstructing a peace officer, and failure to register as a violent offender.

Additionally, Friscia allegedly tested positive for methamphetamine and marijuana in October, violating another condition of his probation.

In both cases, the court sentenced Friscia to ten years in MSP with none suspended and no parole restriction. The sentences are also slated to run concurrent to any sentences from Spokane.

Friscia will receive credit for time spent in LCJ and in Boot Camp.
