Law enforcement and court records - Dec. 26

| December 27, 2013 10:50 AM

District Court, Judge Manley presiding

*The following took place on Dec. 18.

-Based on a plea agreement reached for a felony drug charge, Lorena Couture was sentenced to DOC for three years with all suspended except for thirty days. She will receive credit for time served.

An affidavit filed in Couture’s case file indicates that in Nov. 2012, she was arrested on an outstanding warrant and was found to be in possession of a syringe and a bent spoon. Testing at the State Crime Lab confirmed that there was methamphetamine inside the syringe.

-Facing charges of drug possession and forgery from separate criminal cases, Misty Hendrickson was sentenced to DOC for ten years with eight years suspended and had another sentence deferred for three years.

Records state that in July, Hendrickson was contacted by Tribal Police after employees at Hanson and Granley Hardware in Ronan reported two individuals buying items and then returning them for cash. The check written to obtain the items was allegedly linked to a closed account.

Court documents reflect that over the next several weeks, Hendrickson was tied to numerous reports of passing bad checks throughout the area. When interviewed by an officer, Hendrickson “denied forging the checks, but did admit passing the checks knowing that they were written on a closed account.”

Later, in August, court records state that Hendrickson was arrested for DUI. Officers initiating the stop reportedly found drug paraphernalia in the car. A later search conducted at the Tribal Police station revealed that Hendrickson had been concealing two pills of methadone, a controlled substance.

-Tyler Erickson, 20, appeared in court for arraignment and pleaded not guilty to a felony charge of criminal possession of dangerous drugs. The matter was set for an omnibus hearing on March 5, with a jury trial commencing on April 14.

Court documents state that in October, authorities responded to a dispute at the residence where Erickson had been living with his mother and found “several items of drug paraphernalia consistent with methamphetamine abuse.”

-Standing accused of “receiving social security benefits in excess of what [she was] entitled to”, Rose Knott, 51, of St. Ignatius, pleaded not guilty to felony charges of theft.

An affidavit in the case states that in 2010, the Social Security Administration received word that Knott and her husband, David Knott, were providing the agency with misleading information.

Knott’s husband was allegedly “concealing employment by using his son’s social security number”, and Rose was “reporting that she lived alone when in fact David was living with her.”

The court set the matter for an omnibus hearing on Feb. 13 with a jury trial commencing on March 24.

-Jay Calvin Smith, 25, of Ronan, changed his plea and admitted to a felony drug charge in addition to a misdemeanor instance of criminal mischief from a separate case. Smith will be sentenced on Jan. 30.

Court records reflect that on Aug. 5, Smith admitted to Lake County undersheriff Dan Yonkin that there were several bags of methamphetamine in his car, and consented to a search of the vehicle.

Records also state that in July, Smith’s car was impounded after reports of shots being fired from the vehicle in the Pablo area. After being released from custody later that night, Smith allegedly tried breaking into the complex where his vehicle was being held. He later admitted trying to break into the garage to retrieve drugs that were found during a search of his vehicle.

*The following took place on Dec. 19.

-Carla Goodwin, 31, entered a plea of not guilty in response to a litany of criminal allegations, including felony DUI and drug charges.

Court documents state that in December 2012, Goodwin was pulled over near Ninepipes Lodge for a suspected DUI. Goodwin, who was driving on a revoked license and had been identified as a “habitual traffic offender”, failed numerous field sobriety tests. Additionally, a search of her vehicle and belongings allegedly revealed marijuana, two bags containing a white, powdery residue, and various pills. Her blood tested positive for marijuana, methamphetamine and the dangerous drug, alprazolam.

Goodwin will next appear in court for an omnibus hearing on Jan. 30, with a jury trial set to commence on March 10.

-For two felony DUI charges, Roy Bundy, 48, of Polson, was sentenced to the DOC for two identical terms of 13 months apiece. In both cases, if Bundy successfully completes alcohol treatment, the remainder of the sentence must be served on probation.

Additionally, Bundy received a five-year suspended sentenced to the DOC from each case. According to court records, one of the DUI charges stems from Aug. 17, with another occurring on Nov. 6, when Bundy reportedly crossed over the centerline of Highway 93 around 3 p.m. After being stopped by law enforcement, Bundy provided a breath sample of .331.

-Appearing in court for an adjudicatory hearing, Dillard Miller was sentenced to MSP for ten years after admitting to drinking and driving in early November and having a suspended sentence revoked.

Court documents indicate that Miller is “a persistent felony offender with multiple felony DUI convictions.”

-Josh Pierre, 36, of Ronan, entered a change of plea and admitted to dual felony charges of assault on a peace officer. Pierre will be sentenced on Jan. 30.

Court records state that on Oct. 30, while at the Tribal Jail, Pierre swung his belt at one officer, and then struck another officer in the face with his knee.
