Lake County District Court, Judge McNeil presiding

*The following district court cases took place on Jan. 2.

- State of Montana vs. Gene Adams. The matter before the court is sentencing. For the offense of driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony, the court commits Adams to the Department of Corrections for placement in an appropriate correction facility for 13 months followed by 2 years suspended.

-State of Montana vs. Steven Mikkelson. The matter before the court is for arraignment. Mikkelson pled guilty to the offense of driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony. Psychiatric evaluation ordered. Sentencing is set for Wednesday, Feb. 6 at 9 a.m.

- State of Montana vs. Billy Washburn Jr. The matter before the court is change of plea.  Washburn admits committing the offense of driving under the influence of alcohol or drugs, a felony. The court accepts the plea and finds the defendant guilty of the charge.  Psychiatric evaluation  ordered. Sentencing is set for Wednesday, Feb. 6 at 9 a.m.

-State of Montana vs. David Okland. The matter before the court is for hearing of merits. Okland made admissions of probation violations and his suspended sentence was revoked. For the offense of driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony, the court commits the defendant to the Department of Corrections for 5 years to be placed in an appropriate correctional facility.  

-State of Montana vs. Lorena Couture. The matter before the court is for hearing of merits. Couture made admissions of probation violations and her suspended sentence was revoked. For the offense of criminal endangerment, a felony, the court commits Couture to the Department of Corrections for 5 years to be placed in an appropriate facility. Couture is to receive credit for time served  while in custody. The court recommends Couture be screened for treatment provided it meets with the approval of the department of corrections.

*The following district court cases took place on Jan. 3.

- State of Montana vs. Bethany Caye. The matter before the court is sentencing. For the offense of criminal possession of dangerous drugs, a felony, the court defers imposition of sentence for a period of 3 years. In addition Caye shall serve 60 days in the Lake County Jail within 4 months of sentencing. Caye may receive credit for time served if she successfully completes an inpatient chemical dependency treatment program.

-State of Montana vs. Richard Moulton II. The matter before the court is sentencing. For the amended offense of driving under the influence of alcohol or drugs, a felony, the court commits the defendant to the Department of Corrections for 13 months. In addition Moulton is sentenced to 2 years suspended.

-State of Montana vs. Keith Edmonson. The matter before the court is arraignment. Edmonson pled not guilty to the charge of assault with a weapon, a felony, and partner or family member assault, a misdemeanor.

The court sets this matter for omnibus hearing on Thursday, Feb. 28 at 9 a.m. with a jury trial commencing on Monday, April 8 at 9 a.m.

- State of Montana vs. Merle Jore. The matter before the court is sentencing. For the amended offense of criminal endangerment, a felony, the court commits the defendant to the Department of Corrections for 5 years with all suspended but 30 days in the Lake County Jail or successful completion of inpatient treatment. Inpatient treatment has been satisfied.

- State of Montana vs. Edward Truman. The matter before the court is change of plea. Acknowledgement of rights and plea agreement ordered filed. The court has reviewed and accepts plea agreement.  Truman admits committing the amended offense of criminal possession of dangerous drugs, a felony. The court makes its findings, accepts the plea and finds the defendant guilty of the charge.

Psychiatric evaluation ordered. Sentencing is set for Thursday, Feb. 14 at 9 a.m.

*The following justice court proceedings took place Dec. 28-Jan. 3.

- Joshua Simpson; 22. Criminal mischief pecuniary loss less than $1,500, a misdemeanor.  180 days in jail with 180 suspended. Fined $100. Criminal possession of drug paraphernalia, a misdemeanor. 180 days in jail with 180 days suspended. Fined $100. Criminal possession of drug paraphernalia, a misdemeanor. 180 days in jail with 180 days suspended. Fined $150. Criminal possession of dangerous drugs - marijuana (60 grams or less) - second offense.  181 days in jail with 180 suspended. Fined $150.

- Marlene Cramm; 51. Operating with alcohol concentration of 0.08% BAC or greater - first offense, a misdemeanor. 180 days in jail with 180 suspended. Fined $1,000.

- Benjamin Rabunski; 27. Reckless endangerment of a highway worker- first offense, a misdemeanor. Fined $150.

- Ted Fellman; 41. Improper passing-highway ahead obstructed, a misdemeanor. Fined $50.

- James Schreckendgust; 40. Operating a vehicle with weight greater than the maximum authorized, a misdemeanor. Fined $375.

- Greg Bierie; 61. Operating with expired registration -failure to reregister, a misdemeanor. Fined $50.

- Dar Schmid; 44. Improper passing - in no-passing zone, a misdemeanor. Fined $50.

Polson City Court, Judge Olson presiding

*The following city court proceedings took place Dec. 29-Jan. 4.

- Kara Elmore; 23. Reckless driving - first offense, a misdemeanor. 10 days in jail with 10 days suspended. Fined $300.
