District Court briefs, Judge Christopher presiding
*The following took place on Oct. 31.
-Cecilia Basilio, 35, of Ronan, appeared in district court for sentencing in relation to a felony offense of forgery. In a ruling based on a plea agreement, Basilio was given 10 years, all of which was suspended except for a 30-day stint in the LCJ that is to be completed within the next three months. Basilio has been granted credit for time already served.
Court documents indicate that in May 2012, Basilio was apprehended at a Polson store where she was attempting to pass a bad check. Basilio was found to be in possession of numerous old checks belonging to her ex-husband, who had been deported from the country in 2009.
-30-year-old Darwin Zempel, of Ravalli, appeared in district court and pleaded not guilty to a felony charge of criminal possession of dangerous drugs. The matter was set for an omnibus hearing on Dec. 4, with a jury trial commencing on Jan. 27.
The charges stem from an incident on Oct. 8, when court records state that Zempel “reported to his probation officer and tested positive for methamphetamine.” A search of Zempel’s car revealed several used syringes, a snort tube, a spoon with residue on it, and a “crystal-like powder nugget” believed to be methamphetamine.
-Former Polson resident, Louis Ted Caye, 43, was given five years in the MSP after having a suspended sentence revoked in an adjudicatory hearing.
The court upheld a petition to revoke Caye’s suspended sentence from a 2011 felony intimidation conviction, after he was found to have violated several conditions of his probation, including failure to report to work and failure to abstain from alcohol.
-Convicted violent offender Victor Demery, 29, of Polson, was sentenced to the DOC for four years for failing to give notice of a change of address, a felony. Demery had received a felony arson conviction in North Dakota in 2005 – an offense that, under Montana law, requires registration as a violent offender. Court records state that Demery “had been told by at least four different officers that he needed to register” but failed to comply with the requests.
