*The following took place from Nov. 8 to Nov. 14.

-Vasiliy Buzyan, 51. Careless driving, a misdemeanor. Fined $85.

-William Sullivan, 41. Speeding - exceeding restricted zone limit, a misdemeanor. Fined $55.

-James Nash, 21. Speeding - exceeding day limit of 65 mph, a misdemeanor. Fined $40.

-Barbara Goodwin, 52. Driving under the influence of alcohol - first offense, a misdemeanor. Fined $485. 6 months in jail, with 179 days suspended.

-Katherine Yakubowski, 24. Speeding - exceeding day limit of 70 mph, a misdemeanor. Fined $20.

-Zachary Malinak, 22. Stop sign violation, a misdemeanor. Fined $85.

-Martin Herak, 63. Seatbelt violation, a misdemeanor. Fined $20.

-Karen Kleinklaus, 65. Speeding - exceeding restricted zone limit, a misdemeanor. Fined $65.

District Court, Judge Manley presiding

*The following took place on Nov. 13

-Billie Boushie was sentenced to DOC for five years, with another five-year term suspended upon successful completion of the recommended Elkhorn Treatment Program.

Charges in two separate cases facing Boushie were dropped based on new information received following the submission of a guilty plea in September.

Boushie had faced DUI-related charges from three separate incidents that occurred from May to August of this year. According to court records, there were children riding in Boushie’s vehicle during all three arrests.

-Ronnie Boyce appeared in court and entered a plea of not guilty to the charge of criminal possession of dangerous drugs, a felony.

Court records reflect that on Sept. 22, Lake County Sheriff’s deputies responded to a possible attempted suicide in Charlo. Boyce, who is a nurse at St. Luke Hospital in Ronan, was initially “found asleep or unconscious in bed” and “appeared confused and upset” upon being disturbed. As emergency personnel arrived, the responding officers discovered syringes and pharmaceuticals in the sink, including the drug, hydromorphone. The affidavit states that “the medications were packaged for hospital use rather than distribution through a pharmacy.” Further investigation confirmed that the hydromorphone found in the residence matched that from a recent shipment to the hospital.

The matter has been set for omnibus hearing on Dec. 18, with a jury trial commencing on Feb. 3.

-Andrew White, 27, of Ronan, came before the court for arraignment and pleaded not guilty to felony counts of aggravated assault and intimidation.

The charges stem from an incident on Oct. 20, when authorities responded to a report of domestic abuse from the defendant’s wife. Court documents state that the victim told the responding deputy that White had been drinking all night and eventually started an argument. An affidavit indicates that the argument escalated and White began choking his wife before throwing her to the floor and “banging her head off the ground” repeatedly. The victim eventually managed to leave the residence and went to her sister’s house, where she called police. The officer reported observing bruises, red marks and scratches on the victim’s neck and wrists.

The court set the matter for omnibus hearing on Jan. 15 with a jury trial commencing on Feb. 18.

-Dessilynn Brown, 25, of Polson, appeared in court for arraignment and pleaded not guilty to a felony charge of criminal possession of dangerous drugs.

Court documents state that Brown was arrested by the Polson Police Department on Oct. 19 for a suspected attempted burglary, and mentioned to the arresting officer that her boyfriend would be mad at her for gambling and snorting methamphetamine that night.

After being transported to the Lake County Jail, Brown’s boyfriend dropped off her purse. Reports state that an inspection of the purse’s contents revealed several syringes, a spoon and a baggie of white powder identified as meth.

The case was set for an omnibus hearing on Jan. 15, with a jury trial commencing on Feb. 18.

-Misty Hendrickson appeared in court for arraignment and a change of plea, in relation to a number of cases. Pursuant to a plea agreement, Hendrickson pled guilty to felony charges of forgery and possession of dangerous drugs.

Charges in another case were dismissed by the court subject to sentencing in the other two matters.

Records state that in July, Hendrickson was contacted by Tribal Police after employees at Hanson and Granley Hardware in Ronan reported two individuals buying items and then returning them for cash. The check written to obtain the items was allegedly linked to a closed account. Court documents reflect that over the next several weeks, Hendrickson was tied to numerous reports of passing bad checks throughout the area. When interviewed by an officer, Hendrickson “denied forging the checks, but did admit passing the checks knowing that they were written on a closed account.”

Later, in August, court records state that Hendrickson was arrested for DUI. Officers initiating the stop reportedly found drug paraphernalia in the car. A later search conducted at the Tribal Police station revealed that Hendrickson had been concealing two pills of methadone, a controlled substance.

Sentencing was set for Dec. 18.

-Derrick Shields, 51, of Pablo, came before the court to reverse a plea, and admitted to a felony DUI charge.

An affidavit for the case states that on July 16, Shields was involved in a single-vehicle accident after missing a turn and driving through a barbed wire fence at a “T” intersection. The record indicates that the responding officer noticed a marijuana pipe sitting on the dashboard and that a blood sample collected from Shields following the incident registered a blood alcohol level of .214. Shields’ driving record reflects at least three prior DUI convictions.

Sentencing is set for Jan. 8.

-Lorena Couture appeared in court for a change of plea, admitting to a felony count of criminal possession of dangerous drugs.

Court documents indicate that Couture was arrested in Polson on Nov. 25, 2012 on an outstanding warrant. A search of Couture’s purse revealed a syringe that tested positive for methamphetamine.

Sentencing is set for Dec. 18.

-Bowdrea Nicolai reversed a plea and pled guilty to felony drug charges.

Records state that Nocolai was booked into Tribal Jail in January on an unrelated matter, when a search of his belongings revealed two hydrocodone pills.

Sentencing is set for Jan. 8.

*The following took place on Nov. 20.

-Polson’s Marc Friscia, 25, appeared in court to answer a petition to revoke, and entered a general denial of the allegations in the report of violation.

Friscia had a deferred sentence stemming from a 2010 felony conviction for tampering with or fabricating physical evidence. Friscia has been accused of violation several conditions of his probation, including unauthorized travel, allegedly failing to appear for scheduled appointments with his probation officer, and possessing firearms and ammunition.

The court set the matter for an adjudicatory hearing on Nov. 20.

-Roy Bundy, 48, of Polson, came before the court for a status hearing and arraignment on two separate cases. After providing sworn testimony, the court accepted Bundy’s plea and found him guilty of felony counts of driving under the influence in both cases.

Records state that Bundy was pulled over in August after making an unlawful pass on U.S. Highway 93. Bundy provided a breath test that registered a .214. An open beer can that was still cold was also reportedly found in Bundy’s vehicle.

Court documents recount another incident from the afternoon of Nov. 6, in which Bundy was stopped after being observed crossing over the center line on Highway 93. A preliminary breath sample of .331 was recorded on the scene. Another sample taken an hour after the arrest registered a .293. Bundy reportedly stated that this would be his fifth DUI.

Sentencing is set for Dec. 19.

-Russell Wentz, 48, of Ronan, pleaded not guilty to felony counts of burglary and attempted sexual intercourse without consent, in addition to misdemeanor charges of sexual assault, partner or family member assault and criminal mischief.

An affidavit states that on Oct. 27, Wentz’ ex-girlfriend reported that Wentz broke into her residence and attempted to rape her. Court documents state that Wentz had been cited numerous times for assaulting the victim, including approximately three days prior, when he allegedly stabbed her with a machete.

The court set the matter for an omnibus hearing on Dec. 19 with a jury trial commencing on Feb. 10.

-Joshua Pierre, 36, of Ronan, came before the court for arraignment and pleaded not guilty to a felony charge of assault on a peace officer.

Court documents state that on Oct. 30, Pierre was being booked into Tribal Jail and struck a tribal police officer with his belt when asked to remove his clothes. Pierre then allegedly struck another officer in the face with his knee, causing minor bleeding.

The court set the matter for a Nov. 21 bail hearing, with an omnibus hearing set for Dec. 19 and a jury trial scheduled to begin on Feb. 10.

-Autumn Lea Cain pled not guilty to a felony count of attempted assault on a peace officer.

The charge stems from an incident on Oct. 4, when a Ronan Police officer attempted to transport Cain home after initially responding to a report of a disorderly individual at the Second Chance Saloon. Records state that Cain was uncooperative throughout the process and attempted to strike him with her forehead.

The matter was scheduled for an omnibus hearing on Jan. 16 with a jury trial commencing on Feb. 24.

-Rachel Burks, 34, of Ronan, appeared in court for arraignment and pleaded not guilty to a felony charge of assault with a weapon.

Court records state that on Oct. 7, Burks pointed a gun toward her husband and threatened to kill him before firing a bullet into the floor between his feet. The affidavit states that she appeared to be intoxicated, and was belligerent and uncooperative with responding officers attempting to measure her blood alcohol content.

The court set the matter for an omnibus hearing on Jan. 16 with a jury trial commencing on Feb. 24.

-20-year-old Samuel Sharp, of Pablo, pled not guilty to a felony count of criminal possession of dangerous drugs.

The charges stem from an incident on Jan. 6, when Sharp was stopped for speeding on Highway 212 in Lake County. Court records state that a search of Sharp’s vehicle revealed a glass pipe and three small plastic bags “containing white crystalline powder consistent with methamphetamine.”

Sharp will have an omnibus hearing on Jan. 16, with a jury trial commencing on Feb. 24.

-Polson’s Melvin Madplume, the 29-year-old who stands accused of raping and killing his cousin, Laurence Kenmille, in an incident at Wild Horse Hot Springs earlier this year, had his omnibus hearing pushed back indefinitely based on motions filed by his defense. The hearing was originally set to be held Nov. 21.
