District Court briefs, Judge Christopher presiding

*The following took place on Oct. 17.

-Facing forgery charges and other offenses that violated the conditions of his probation for prior drug-related convictions, Casey Plant, of Big Arm, appeared for sentencing in one court case, and sentencing on revocation in another. In the first matter, the court committed Plant to DOC for five years with none suspended on count II, and on count III, issued a suspended five-year sentence to run consecutive to the other ruling. In the second matter, the court levied an additional five-year suspended sentence, for a total of fifteen years, with ten suspended. Plant is to receive credit for time in custody and is ordered to pay restitution in the amount of $2,734.11.

-Victor Morigeau, 54, of Ronan, came before the court for a change of plea, and admitted to committing the felony offenses of two counts of assault on a police officer, and driving while under the influence of alcohol or drugs.

The charges stem from an incident on Feb. 8, when Morigeau was seen driving dangerously and erratically through Ronan and attempted to evade law enforcement officials trying to pull him over. During the lengthy pursuit that ensued, Morigeau drove his vehicle through private fields and an adjacent wildlife refuge. At one point, his truck became stuck, and when the officer approached him with his weapon drawn, court documents state that Morigeau attempted to run over the deputy. Morigeau was eventually subdued after resisting arrest. Besides appearing highly intoxicated, he was found to be in possession of a “snort tube” with a white substance inside.

Sentencing in the case is set for Nov. 20.

-Lorena Couture appeared in court for arraignment and pleaded not guilty to criminal possession of dangerous drugs, a felony.

On Nov. 12, 2012, Couture was arrested on an outstanding warrant and was found to be in possession of a syringe that tested positive for methamphetamine.

The court set the matter for omnibus hearing on Nov. 27, with a jury trial commencing on Jan. 21.

-Vincent Burrafato, 38, of Charlo, appeared for arraignment and pleaded not guilty to the charge of driving under the influence of alcohol or drugs, fourth or subsequent offense.

Burrafato’s most recent arrest occurred early in the morning on Oct. 1, when court records state that he was found “slumped over in the driver’s seat and drooling” in a green jeep at the intersection of Skyline Drive and Caffery Road in Polson. Burrafato allegedly fought with the arresting officers and kicked at windows after being placed in a patrol vehicle.

-George Coffey, 64, of Dixon, appeared in court to reverse his plea and admitted to a felony offense of criminal possession of dangerous drugs. The court accepted the plea and set sentencing for Nov. 20. The charges stem from an arrest on April 4, when Coffey was found in possession of a substance appearing to be methamphetamine.

-Ashley Sorells, 27, of Ronan, appeared before the court for sentencing. Pursuant to a plea agreement, the court sentenced Sorells to DOC for 20 years, with 15 years suspended, for a felony offense of vehicular homicide under the influence. The incident occurred in Sept. 2012 when Mark Felsman died as a passenger in her vehicle, when she crashed while giving Felsman a ride home to Arlee from the Evaro Bar.

Blood tests revealed that, at the time of the crash, Sorells had a blood alcohol content of 0.18 and also tested positive for THC, the active ingredient in marijuana.

-Gavin Gardipe, 23, of Ronan, appeared before court for a change of plea and admitting to committing the offenses of accountability (burglary), a felony, and theft, a misdemeanor. Gardipe further admitted to amended misdemeanor counts of assault and theft from separate cases.

Sentencing is set for Dec. 11.

-Jesus Lopez III, a 22-year-old Spokane resident, was given a three-year deferred sentence for felony accountability (burglary) charges from his role aiding in the after-hours robbery of the Ronan Subway in Oct. 2012.

-Earl Matt, Jr., 38, of Polson, was sentenced to DOC for a term of 13 months for a felony offense of driving while under the influence of alcohol or drugs. If Matt successfully completes an alcohol treatment program, the remainder of the sentence must be served on probation. Matt was issued an additional three year sentence, but all of that time was suspended.

The charges stem from an infraction on Oct. 25, 2012, when Matt was pulled over on Highway 93 and registered a blood alcohol level of 0.17.

-Jeremiah Mitchell, 23, appeared before the court for a change of plea and sentencing on revocation. Mitchell pled guilty to felony counts of burglary and criminal possession of dangerous drugs, stemming from separate cases.

In April, Mitchell admitted to breaking into a St. Ignatius home and stealing items that included prescription pills.

Sentencing is set for Nov. 20.

-Wayne Twoteeth, 45, of Helena, reached a plea agreement and admitted to a felony offense of driving under the influence of alcohol or drugs. The admissions satisfy a petition to revoke stemming from earlier offenses.

On July 13, Twoteeth was apprehended at a Ronan gas station, while he appeared to be drunk. Twoteeth refused to comply with requests for a breath test and was arrested.

Court records indicate that Twoteeth has nine prior DUI convictions. Twoteeth will be sentenced on Dec. 4.
