Law enforcement and court records - Oct. 31
District Court Briefs, Judge Christopher presiding
*The following took place on Oct. 24.
-Anthony Coble appeared in court for sentencing related to a July 2012 arrest for three felony counts of possession of dangerous drugs, including hallucinogenic mushrooms, L.S.D., and ecstasy. Pursuant to a plea agreement that had been reached, Coble was committed to DOC for five years, all of which was suspended except for time already served. Two of the counts facing Coble were dismissed by the court and a $10,000 cash bond was returned to Coble at the request of his attorney.
-Cindy Umphrey, 50, of Ronan, came before the court for a change of plea, and admitted to two felony counts of criminal possession with intent to distribute. Sentencing will be delayed until Umphrey completes an RTEC program. The court also moved to dismiss another case against Umphrey pursuant to a deferred prosecution agreement.
-For violating conditions of a suspended sentence for felony criminal endangerment, the court committed 42-year-old Billie Jo Healy of Ronan to DOC for four years with all of that time suspended except for 30 days in the LCJ.
-30-year-old Harold Mitchell, of Pablo, admitted to criminal possession of dangerous drugs and tampering with or fabricating physical evidence, both felonies. The court vacated a previously established trial date and scheduled sentencing for Nov. 27. The charges stem from a 2012 arrest in which Mitchell was found to be concealing several bags of methamphetamine.
-Charlo resident Steve Scholten, 44, had a suspended sentence from a 2011 felony DUI conviction revoked after admitting before the court that he failed to comply with conditions of his probation. The court committed Scholten to DOC for two years and granted him credit for time served while in custody. Records state that the court made specific recommendations that Scholten be screened by DOC to determine an appropriate treatment program.
-Eneas Conko, 34, of Polson, had a suspended sentence revoked after making admissions before the court. In 2009, Conko was convicted of felony criminal possession with intent to distribute, and last year was found to have violated conditions of his parole by both possessing drug paraphernalia, and for failing to report to his probation officer as directed.
-23-year-old Jamie Kibler, of Polson, had a deferred sentence for forgery revoked after making admissions related to various probation violations. Kibler’s deferred sentence was handed down in July, but since that time she has violated conditions of her parole by failing “to seek or maintain gainful employment” and for driving a vehicle with a suspended driver’s license. The court committed Kibler to DOC for 15 years with ten years suspended.
-Tasha McDanal, 30, of Polson, came before the court for arraignment and pled not guilty to a felony charge of criminal distribution of dangerous drugs. According to court documents, on Oct. 9, a confidential informant bought 10 ounces of methamphetamine from McDanal at a Lake County gas station for $3,500, using documented bills provided by the North West Drug Task Force. McDanal was arrested immediately following the transaction. A search of McDanal’s car revealed additional methamphetamine, drug sale ledgers, and records of wire transfers.
-Wilbur Usher, a 39-year-old resident of Elmo, was handed a deferred three-year sentence for criminal possession of dangerous drugs. Usher was ordered to serve thirty days in the LCJ or inpatient treatment. The ruling indicated that the program will be waived upon successful completion of 240 hours of community service within six months.
-Elizabeth Courchene appeared before the court for adjudicatory hearing and had a suspended sentence revoked. The court issued Courchene a three-year sentence with DOC, and granted credit for time served while in custody. Courchene’s original conviction was for fraudulently obtaining dangerous drugs and criminal possession of dangerous drugs.
