District Court, Judge Manley presiding
*The following took place on Wednesday, March 26
-Christopher Vidulich, 56, of Kalispell, appeared in court to change his plea to the charge of misdemeanor partner or family member assault to guilty. Previous charges of felony assault with a weapon and felony burglary were dropped by the court.
An affidavit states that on Dec. 25 Lake County Sheriff’s deputies responded to “a call of domestic disturbance with shots fired.” Vidulich’s estranged wife was one of two individuals present at the location, and told officers that Vidulich had kicked open the front door. She had had a pistol and “pointed it at [Vidulich], telling him to leave.”
Instead, according to court records, Vidulich charged and grabbed the gun, which discharged several times in the ensuing struggle. Eventually the gun was taken away from Vidulich, who was ordered to leave, and later arrested by a Kalispell police officer.
Vidulich was sentenced to one year in Lake County jail with all but two days suspended.
District Court, Judge Christopher presiding
*The following took place on Thursday, March 27
-Thomas English, 28, of Everett, Wash., had a two-year suspended sentence revoked for a parole violation.
English’s alleged violations include changing residences without permission, failing to report to a probation officer as directed, violating a ban against illegal drug use and alcohol use.
The court sentenced him to two years in prison.
-Samuel Sharp, 20, of Pablo, appeared in court for an omnibus hearing on the charge of criminal possession of dangerous drugs, a felony. Sharp pleaded guilty to those charges.
Court records indicate that on Jan. 6, 2013, Sharp was pulled over on Highway 212 in Lake County for speeding by tribal police and lied about his identity. Tribal officers found methamphetamine and a pipe in the vehicle.
The court has set sentencing for Thursday, May 1 at 9 a.m.
-Crystal Merry, 30, of Anaconda, appeared in court for sentencing.
An affidavit indicates that Merry was arrested on Sept. 12, 2011 in Texas in a 1998 Honda Civic she had borrowed from Charles Shull and never returned. The car had been reported stolen six days prior to her arrest.
By the terms of a plea agreement, Merry was sentenced to three years deferred with 20 days in Lake County Jail for the crime of felony theft.
-Desmond Mackay, 35, of Polson, appeared in court to enter a plea of not guilty on the charges of deliberate homicide, a felony, and assault with a weapon, also a felony.
Court documents indicate that, on the evening of March 5, Desmond and Jesse Waugh, of Polson, engaged in an altercation during which Mackay allegedly assaulted Waugh, his brother-in-law, with a hammer in the alley behind 509 4th Avenue East in Polson.
Mistaking Barrows for Waugh in the doorway of the garage, Mackay swung at Barrows and hit him squarely on the head with the hammer before pursuing Waugh, who later suppressed Mackay until authorities arrived.
Barrows was airlifted to Kalispell Regional Medical Center for emergency surgery, where he died 10 days later.
The court has set an omnibus hearing for Thursday, April 24 at 9 a.m. with a jury trial commencing on Monday, June 23 at 9 a.m.
