District Court, Judge Manley presiding

*The following took place on Jan. 8.

-Pursuant to a plea agreement, Misty Whitworth, 37, of Ronan, was sentenced to the Department of Corrections (DOC) for five years and had three additional five-year terms suspended for offenses including two counts of criminal child endangerment and criminal possession of dangerous drugs. Whitworth also had a deferred forgery sentence revoked after violating conditions of her probation.

Court records state that in November, Whitworth operated a motor vehicle with children as passengers while she was under the influence of alcohol or dangerous drugs.

The court ruled that Whitworth would be screened for Elkhorn treatment and granted credit for time already served.

-Virginia Green, 28, was sentenced to the DOC for five years, with all of that time suspended except for 40 days to be served in the Lake County Jail (LCJ).

An affidavit states that in Jan. 2013, Green was found to be in possession of a pill of the drug methadone during a search conducted at the tribal jail in Pablo.

-For felony DUIs committed last year, two area men were sentenced to an appropriate correctional facility for 13 months. If Derrick Shields, 51, and Vincent Burrafato, 38, successfully complete treatment, the remainder of their 13-month sentences must be served on probation. The two were also handed additional three-year suspended sentences that will run consecutive to the 13-month term.

An affidavit for Shields’ case states that on July 16, he was involved in a single-vehicle accident after missing a turn and driving through a barbed wire fence at a “T” intersection. The record indicates that the responding officer noticed a marijuana pipe sitting on the dashboard and that a blood sample collected from Shields following the incident registered a blood alcohol level of .214. Shields’ driving record reflects at least three prior DUI convictions.

Burrafato’s most recent DUI arrest occurred early in the morning on Oct. 1, when court records state that he was found “slumped over in the driver’s seat and drooling” in a green jeep at the intersection of Skyline Drive and Caffery Road in Polson. Burrafato fought with the arresting officers and kicked at windows after being placed in a patrol vehicle.

-Philip Friscia, 27, of Polson, entered a change of plea and admitted to a felony drug charge stemming from an Oct. 2012 arrest.

Court records indicate that Friscia was being arrested on an outstanding warrant when officers found drug paraphernalia in his property. A small wrapper was also discovered that contained a substance identified as methamphetamine by a field test.

Friscia will be sentenced on Feb. 12.

-Robert Wyman, 65, reversed a plea and admitted to offenses including misdemeanor partner or family member assault and a felony drug charge.

Court documents state that in June 2011, Wyman pointed a .357 revolver at his wife and threatened to kill her. He then beat her, causing a black eye and bruising, and again threatened to kill her if she notified the police. His wife successfully contacted a friend, who called police, and officers arrested Wyman on the scene. During the arrest, officers also located several marijuana plants that Wyman admitted to growing.

Wyman was jailed and his wife was issued an order of protection. In June 2013, Wyman was released from jail and records state that he called his wife twice and left “a threatening voicemail message demanding that she bring him ‘my weed’ or he would call the cops.” The calls violated the order of protection and Wyman was again arrested.

-Tyler Erickson, 20, reached a plea agreement, admitting to a felony drug charge.

Court documents state that in October, authorities responded to a dispute at the residence where Erickson had been living with his mother and found “several items of drug paraphernalia consistent with methamphetamine abuse.”

Sentencing is set for Feb. 12.

-Brian Wollam, 34, of Charlo, reached a plea agreement and admitted to criminal endangerment and a misdemeanor count of false alarms to agencies of public safety.

In January 2013, Wollam called 911 and falsely reported that a friend of his had rolled a jeep and that there was blood all over the vehicle. As authorities searched for the vehicle, Wollam was pulled over during a traffic stop in Charlo. After being questioned, Wollam admitted to lying about the fake accident.

Wollam will be sentenced on Aug. 6.

District Court, Judge Christopher presiding

*The following took place on Jan. 9.

-For a felony instance of driving under the influence of drugs or alcohol, Wayne Twoteeth, 46, of Pablo, was sentenced to the Montana State Prison (MSP) for 25 years with 15 years suspended. Twoteeth was handed an additional suspended 15-year term after admitting to violating the terms of his suspended sentence from a prior conviction. The sentences were ordered to run consecutive and the court recommended that Twoteeth be enrolled in the WATCH program if he eventually becomes eligible.

Court files indicate that Twoteeth’s latest DUI occurred on July 13, 2013, when he was apprehended at the Town Pump in Ronan after reportedly almost colliding with another vehicle. Records reflect that Twoteeth has nine prior convictions for DUI.

-Facing a felony drug charge, Sheldon Hameline, 33, was sentenced to the DOC for three years, with all of that time suspended except for a period of 30 days. Hameline was already granted credit for that term after completing 35 days in inpatient treatment.

The charge stemmed from a July 2012 incident at the Elmo Standing Arrow Pow Wow, where Flathead Tribal Police officers searched Hameline’s car and found instruments used to smoke methamphetamine. Hameline admitted to the officers that the white crystals in a pipe they had uncovered were methamphetamine.

-After reversing her plea and admitting to misdemeanor offenses of negligent endangerment and driving under the influence of alcohol or drugs, Mary Reed, 45, was given three one-year sentences, all of which were suspended except for 20 days that may be served in Missoula County.

Court documents reflect that on June 14, 2013, Reed was pulled over in Ronan after driving erratically with her two sons in the back seat. Reed “admitted taking several prescription drugs that day” and registered a blood-alcohol level of .114 after being detained.

-Bradley Hout, 24, had a deferred sentence for a 2009 conviction for theft revoked after admitting to violating terms of his probation. According to a report by officer Kim Lahiff, Hout “has violated the conditions of his probation by traveling out of the state of Montana, using illegal drugs, missed appointments, change of residence, quitting his job without permission, etc.”

Hout will be sentenced on Jan. 16.

-Gavin Guardipee, 23, received a 20-year sentence to MSP after making admissions sufficient to revoke a deferred sentence for burglary and theft imposed last month.

None of Guardipee’s 20-year sentence was suspended, although he was not denied eligibility for parole.

On Dec. 12, Guardipee received his deferred and suspended sentences and was advised of the conditions of his probation. He was late for an appointment on Dec. 16 and tested positive for marijuana, methamphetamine and opiates. In the report of violation filed in court, parole officer Janice Flint wrote that Guardipee “was violating the law and using drugs within hours of sentencing” and “has proven he has no intention of complying with the conditions of probation.”

-Maurena Twoteeth, 23, of Pablo, appeared in court for arraignment and pled not guilty to a felony burglary charge.

The charge stems from an incident on Nov. 26, when law enforcement officers responded to a call from a Ronan man who reported that “a woman he didn’t know had entered his house.”

Court records state that the woman, later identified as Twoteeth, told the homeowner that she was looking for someone and went into the bathroom and began searching through the medicine cabinet. When ordered to leave by the homeowner, Twoteeth allegedly became aggressive and yelled threats before exiting and getting into a silver car.

Twoteeth had an omnibus hearing scheduled for Feb. 27 with a jury trial commencing on April 7.

-Jonathon Charlo pled not guilty to a charge of assault with a weapon.

An affidavit for the case states that on Dec. 14, Charlo “purposely and knowingly pointed a realistic-looking BB pistol” at another person at the Quicksilver gas station in Pablo, after being yelled at for urinating in the car wash. The charge appears to be supported by video surveillance from the gas station.

Charlo will next appear in court for an omnibus hearing on Feb. 27, with a jury trial commencing on April 7.
