Man denies driving drunk with children in car
An Alberton man has denied charges alleging he put two young children in danger after he was arrested near Ravalli for driving with a blood alcohol content more than twice the legal limit.
Jonathan Charles Devoe, 31, pleaded not guilty to felony criminal engagement in Lake County District court on Nov. 10.
According to court documents, Devoe was arrested on Oct. 21 after officers were notified of a vehicle driving erratically near Ravalli. Officers located the vehicle and witnessed it drive 22 mph under the speed limit, vary speed widely and drift outside of its lane.
When officers pulled the vehicle over, Devoe, the driver, allegedly smelled strongly of alcohol and had two empty beverage cans in the front of his vehicle. Officers then discovered and 5-year-old and a 4-year-old in the backseat. Devoe allegedly told officers he had consumed two alcoholic beverages that night.
Devoe failed three different field sobriety tests and blew 0.208 on a blood alcohol content meter, the documents state. The legal limit to drive is 0.08 percent.
A jury trial was scheduled for Feb. 13, 2017.
