Polson settles lawsuit over water main
A settlement between Sandry Construction and the city of Polson has been reached, according to city officials.
The lawsuit is in regards to a breach of contract, trespass and other items, on a water main extension for a project called Center Addition, consisting of three blocks of water and sewer main that was replaced in the area of 5th Street and 10th Avenue.
According to City Manager Mark Shrives, officials learned of the lawsuit in October 2016, and since then, he said that both sides have gone “through the legal process,” including looking at the claim itself and legal fees.
Shrives said that the approved settlement was for $8,000, negotiated down from the initial claim of $32,000.
The settlement is “not admitting any liability; it’s just an agreement to settle,” he said.
During the Dec. 4 Polson City Commission meeting, commissioners met during an executive session to discuss the settlement, then passed the decision during the public portion of the meeting.
