Assumption of criminal jurisdiction of Flathead Indian country. Corbett, presented the Lake County Commissioners with Tribal Ordinance 40-A requesting they consent to the ordinance which is a requirement M.C.A., 2-1-302, (2); and WHEREAS, The State of Montana, per M.C.A., 2-1-302, was obligating and binding itself to assume the criminal jurisdiction ; and WHEREAS, In 1964 this resolution was not seen to have a significant impact on local law enforcement, prosecution or social services the board of commissioners consented to and approved Tribal Ordinance 40-A on May 20, 1964; and WHEREAS, Lake County has been a participant in an agreement to implement Public Law 280 between CSKT and the State of Montana since 1964, pursuant to Public Law 280; and WHEREAS, This agreement has provided significant benefits to all residents of Lake County in respect to crime prevention, investigation, deterrence, prosecution, rehabilitation and treatment; and WHEREAS, The circumstances surrounding this agreement and its implementation has changed significantly in 40 years such that at this time the following circumstances exist: 1) A significant number of felonies are being committed in Lake County by Tribal members 2) Tribal members are significantly over represented in proportion to their population in committing crimes requiring temporary incarceration 3) Lake County's tax base or other revenues are no sufficient to fund continued participation in Public Law 280 as costs to Lake County are significant over 2 million dollars annually, and WHEREAS, Lake County is without adequate revenue to fund construction of a Detention Center or added law enforcement to provide for continued participation in Public Law 280; and WHEREAS, Lake County diverts resources from other County services to the detriment of all Lake County residents in order to facilitate continued participation in Public Law 280, which actions the county can no longer continue; and WHEREAS, Lake County does not have the economic resources to continue participation in Public Law 280 without detriment to the real property taxpayers of Lake County, Montana; and WHEREAS, The State of Montana and the Confederated Salish & Kootenai Tribes are not providing funding for County costs incurred from Public Law 280; and WHEREAS, Lake County therefore has no option other than to seek public comment and input upon County withdrawal from the Public Law 280 arrangement; and WHEREAS, Marcy's Law, having been approved by the citizens of Montana will also impose significant costs on Lake County without the necessary ability to pay. NOTICE OF CLASS ACTION SETTLEMENT WITH PPL MONTANA, LLC AND THE MATTSON PLAINTIFF CLASS OF PROPERTY OWNERS ON THE SHORELINE OF FLATHEAD LAKE AND THE BANK OF FLATHEAD RIVER A group of landowners on Flathead Lake and a portion of the Flathead River located in Flathead County filed a class action lawsuit in the Montana Eleventh Judicial District Court, Kalispell, Montana on November 9, 1999 against Montana Power Company ("MPC") and PPL Montana, LLC ("PPLM"). The landowners claimed the power companies' operation of the Kerr Dam caused damages to the landowners' property. The lawsuit is captioned Mattson, et al. v. Montana Power Co., et al., No. DV-99-548A. The Court certified the class which includes the following group of landowners: All persons and entities (other than the United States, the defendants, and the Confederated Salish and Kootenai Tribes of the Flathead Reservation, Montana) that have since November 9, 1991 to December 1, 2006, owned real property either: i) with frontage on the shoreline of Flathead Lake in Flathead County or Lake County, Montana, or ii) which contains a bank of the Flathead River located in Flathead County, Montana, south of the point at which Lower Valley Road (east of U.S. Highway 93) intersects with the Flathead River, or both. This notice is to advise the class that a hearing will be held on March 9, 2017, at 10:00 a.m. at the Montana Eleventh Judicial District Court for Flathead County, 920 South Main, Kalispell, Montana, 59901. The purpose of the hearing is to determine whether the Court should grant approval of the Amended Stipulation of Settlement and General Release between PPLM and the class as fair, reasonable and adequate, whether the application for award of attorney's fees and reimbursement for expenses should be approved, and whether the case should be dismissed with prejudice. A class settlement with MPC and its insurer National Union Fire Insurance Company of Pittsburgh, PA was previously approved by the Court on August 19, 2015.
