If you are unable to attend the hearing, and you would like to comment, you may send us a letter stating your support or opposition to the proposal either by mail or by email to: lakecommissioners@lakemt.gov or Lake County Commissioners 106 4th Avenue East Polson, MT 59860 LAKE COUNTY RESOLUTION 19-07 RESOLUTION OF INTENTION FOR THE PURPOSE OF CREATING A RURAL IMPROVEMENT DISTRICT TO PAVE A PORTION OF IRVINE FLATS ROAD WHEREAS, the Board of Lake County Commissioners has received interest from residents of the City of Polson and Lake County and proposes improving the Irvine Flats Road and; WHEREAS, a portion of Irvine Flats Road owned by the County, lies within the extraterritorial boundary of the City of Polson and the parties hereto find that such roadway is in need of improvement for public safety and; WHEREAS, the County does not have all the necessary funds for improvements and seeks to contribute to the upgrading of the roadway and; WHEREAS, MCA 7-12-2102 (3) requires a joint resolution between the City and the County agreeing to terms of a Rural Special Improvement District for the road improvement and; WHEREAS, project cost is anticipated to be approximately $249,425.00 of which the Road Improvement District will cover $130,200.00 to cover asphalt costs only and; WHEREAS, the boundary of the proposed District shall include the properties whose Tax ID's are listed in the attached exhibit in accordance with the records of Lake County and; WHEREAS, the assessment of costs shall be divided on a per tax id# basis among the 99 benefitted parcels in the District and that the estimated annual assessment will be approximately $291.75 per lot, per year, for five years, including interest (3%) and administration ($2,500.00) and; WHEREAS, a portion of the parcels receiving benefit from this project are lots included in an R.V. subdivision adjacent to the Irvine Flats Road and serviced by the same. A number of those lots are owned by the original developer. To avoid difficulties for that owner, lots still owned by the owner will not be charged now, but will be assessed now, with the P & I assessed on those lots paid in full upon the sale or lease of the same on or before December 31, 2025. Those funds shall repay Lake County any amounts advanced to complete this project prior to payment by those lots. No costs will result to the City or its residents in regard to the County's agreement with the developer; WHEREAS, the City of Polson and Lake signed a Joint Resolution to move forward with creating the Rural Improvement District to Pave a Portion of Irvine Flats Road on March 4, 2019. WHEREAS, a public hearing will be held on Tuesday April 23, 2019 at 10:00 am, where any person affected may appear and be heard for or against the Rural Improvement District.
