LEGAL NOTICE NELSON FLOODPLAIN DEVELOPMENT PERMIT & VARIANCE REQUEST Rob Smith, from A2Z Engineering, on behalf of Russel Nelson, has applied for an after-the-fact floodplain development permit and variance request for residential development placed on structural fill within the FEMA mapped 100-year floodplain of Swan Lake. The applicant previously obtained a permit from Lake County and a LOMR-F from FEMA to allow for structural fill to be placed within the floodplain, effectively revising the floodplain map, creating a building site for a new residence located outside the 100-year floodplain. Any newly constructed residence was required to comply with floodplain standards for structures placed on fill. This after-the-fact application request for a newly constructed residence includes a variance request from the structural fill standards found in Section 10.12 of the Lake County Floodplain Management Regulations. If approved, the variance would allow the fill to be graded at or above the base flood elevation for less than 15 horizontal feet beyond the structure in all directions and the fill would be allowed to be less than 0.5 feet above the base flood elevation.
