LAKE COUNTY COMMISSIONERS No. 21-10 RESOLUTION OF INTENTION TO CALL FOR AN ELECTION FOR A COUNTY ROAD MAINTENANCE MILL LEVY WHEREAS, pursuant to Sections 7-14-2101, 7-14-2102 and 7-14-2103 of the Montana Code Annotated, a Board of County Commissioners has the authority to manage county roads within the county; and, WHEREAS, pursuant to Section 15-10-425 of the Montana Code Annotated, a Board of County Commissioners has the authority to impose a new mill levy by conducting an election as provided in this section; and, WHEREAS, the Board of Lake County Commissioners recognizes the need to raise additional revenue to address public concerns about the safety, maintenance, and improvement of public roads; and, WHEREAS, pursuant to Section 7-14-2507, MCA, the qualified electors in the election will be individuals that possess all of the qualifications required of electors under the general election laws of Montana and are (1) residents of the area subject to the proposed levy; or (2) the owners of taxable property located in the area subject to the proposed levy. Those property owners who are not residents of the area subject to the proposed levy but own property that will be subject to the levy may vote in the mill levy election provided the individual elector is qualified to vote in any county in the State of Montana and files proof of registration with the Lake County election administrator at least 20 days prior to the election; and, WHEREAS, properties located within the incorporated areas of the City of Polson, the City of Ronan, the town of St. Ignatius will not be subject to the proposed levy; and, WHEREAS; the monies raised by this levy will be used to purchase road oil for use in chip seal maintenance projects; and, WHEREAS, the amount of levy is four mills; and, WHEREAS, the approximate amount of dollars raised by the levy will be $221,241 yearly; and, WHEREAS, the levy shall be for a period of two years; and, WHEREAS the impact of the levy election on a home valued at $100,000 will be $5.40 yearly, and the impact on a home valued at $200,000 will be $10.80 yearly; and, WHEREAS a public hearing has been scheduled for June 3, 2021, at 10:00 am to hear testimony from interested persons on whether an election should be held for a county road maintenance mill levy and any other matter relating to a county road maintenance levy; and, NOW THEREFORE BE IT RESOLVED, that at the aforementioned public hearing the Board of Lake County Commissioners will hear testimony: (1) of all interested persons on whether an election should be help for a county road maintenance mill levy; and (2) on any other matter relating to a county road maintenance mill levy. The current lakeshore protection regulations can be provided by the Lake County Planning Department or found on the Planning Department's webpage.
