PUBLIC NOTICE As required under MCA 7-3-173(2), “the governing body shall call for an election, to be held on the primary election date, on the question of conducting a local government review and establishing a study commission….” The Board of Lake County Commissioners will hold a resolution on the draft resolution listed below, on February 21, 2024 at 11:00 am in the Commissioners Chambers located at 106 4th Avenue East, Polson, MT 59860. If you would like to submit comments on the proposed resolution, but are unable to attend in person, please mail your comments to the address above, or by email to lakecommissioners@lakemt.gov Resolution 24-05 Whereas, Article XI, Section 3(1) of the Montana Constitution of 1972 provides that “the legislature shall provide such optional or alternative forms of government that each unit of combination of units may adopt, amend, or abandon an optional or alternative form by a majority of those voting on the question,” and, Whereas, Title 7, Chapter 3, Part 1 sets forth the procedure to execute this term of the Montana Constitution, and, Whereas, Section 7-3-173, MCA, sets forth that an election on the question of conducting a local government review and establishing a study commission must be held every ten years, and, Whereas, that the last such local government review occurred in 2014, and therefore the question must be posed the electorate, in conformance with law, and, Whereas, the Board of County Commissioners is the governing body of Lake County, and desires that the question of local government review, and if answered in the affirmative, its concomitant question of establishing the necessary study commission, should be presented to Lake County voters on the 2024 primary ballot, and, Whereas, if passed by the voters, Lake County shall allow (or impose, as the case may be) $10,000 dollars or mill amount as budget for the study commission, and, Whereas, if passed by the voters, Lake County establish such local government study commission, consisting of (odd number not less than three 7-3-177) nonpartisan study commissioners, who must be duly elected pursuant to law in the 2024 general election. NOW, THEREFORE, BE IT RESOLVED: That the question of conducting a local government review and establishing a study commission shall appear on the 2024 Lake County primary ballots, which shall appear thereon in substantially the following form: “Vote for one: FOR the review of the government of Lake County, Montana, the establishment and funding, not to exceed $10,000.00, of a local government study commission consisting of up to a maximum of 5 members to examine the government of Lake County, Montana, and submit recommendations on the government. AGAINST the review of the government of Lake County, Montana, and the establishment and funding, not to exceed $10,000.00 of a local government study commission consisting of up to a maximum of 5 members to examine the government of Lake County, Montana, and submit recommendations on the government.” And it is further resolved that if the foregoing question is answered in the affirmative by the voters, then and in that event the Board of County Commissioners shall establish the local government review commission and provide it a budget as hereinabove set forth. PUBLIC NOTICE: The Board of Lake County Commissioners will hold a public hearing on Wednesday the 21st day of February, 2024 at 1:30 pm in the Commissioners Chambers located at 106 4th Avenue East, Room 211 of the Lake County Courthouse on the resolution listed below. RESOLUTION OF INTENTION 24-06 TO SELL AND DISPOSE LAKE COUNTY PARK LAND WHEREAS, Montana Code Annotated 7-8-2201, (1), Authorizes Boards of county commissioners to sell, trade or exchange surplus real county property; and, WHEREAS,  surplus property is defined to include land, materials, supplies, equipment and recyclable items regardless of how acquired that are no longer needed to conduct department operations; and, WHEREAS, the Lake County Board of Commissioners have determined that a parcel of county owned park land is surplus and no longer needed; and, WHEREAS, this land parcel is identified by geocode 15-3103-01-2-08-02-0000 and is located in Section 1, Township 21 North and Range 20 West, and consists of 2.2 acres; and, WHEREAS, MCA 7-8-2212 provides that surplus county property may be sold at public auction; and, WHEREAS, the sale may not be made for less than 90% of the appraised value of $85,000; and, WHEREAS, the proceeds shall be deposited into the County Treasury to the credit of the Lake County Park Fund; and, NOW, THEREFORE, BE IT RESOLVED: That the parcel identified by geocode 15-3103-01-2-08-02-0000, and further described as: A parcel of land located in SW1/4NW1/4 AND S1/2 OF LOT 4, S1, T21N R20W, further described as “Park” on the plat of Leanin’ Tree Subdivision, as shown on the map or plat thereof on file and of record in the office of the Clerk and Recorder of Lake County, Montana. 2.2 acres. Shall be appraised, the sale noticed as required by law, and sold under sealed bid at public auction for not less than 90% of its appraised value, the County reserving the right to reject any and all bids, proceeds therefrom to be deposited to the credit of the Lake County Park Fund, and subject to any other terms appearing herein or under Montana law. A sale under this part must be for cash or on terms that the board of county commissioners may approve, provided that at least 20% of the purchase price is paid in cash. All deferred payments on the purchase price of any personal property sold must bear interest at the rate of 6% a year, payable annually, and may be extended over a period of not more than 5 years, and a sale may not be made at public auction or to any school district without public auction for less than 90% of the appraised value. The title to the real property sold under the provisions of this Resolution may not pass from the county until the purchaser or the purchaser’s assigns have paid the full amount of the purchase price into the county treasury for the use and benefit of the county. Hearing on this Resolution of Intent shall be held at1:30 pm on the 21st day of February 2024. This hearing will be held at the Lake County Courthouse in the Commissioners Chambers, 106 4th Avenue East, Polson, MT 59860 Room 211.
