RESOLUTION of INTENTION NO: 24-25 A Resolution of Intent to Impose Special Levy and Borrow Money WHEREAS, Lake County is a Defendant in the Federal cause of action, to wit, In Re: Conditions at Lake County Jail, Cause No. CV-22-127-M-DWM; and, WHEREAS, a judgment was entered by the Court in the above-referenced cause of action requiring the County, among other things, to improve the physical facilities of Lake County Detention; and, WHEREAS, in compliance with the judgment the County consulted expert personnel to effectuate a detention facility upgrade; and, WHEREAS, in order to provide sufficient, integrated space for the court-ordered jail expansion, several County departmental offices must be relocated; and, WHEREAS, the jail facility will require substantial upgrades, including co-option and reconfiguration of spaces currently housing county departments, together with a secure outdoor space immediately adjoining the existing jail, all of which will require construction of tangible assets; and, WHEREAS, the options for housing the necessarily displaced County departments are lease of additional space, or construction of an additional county office building annex, and the Board of County Commissioners adjudges that is in the taxpayer’s best interests to construct an additional building on County-owned real property to house the displaced County departments; and, WHEREAS, the County has engaged experts for the several necessary structure designs and re-designs, as well as estimates of associated costs, and preliminarily finds that the budget for such activities should be: - $ 2,310,000 for so much of the fiscal obligation of the judgment that requires relocation of departments to allow for the expansion of the jail - $ 1,000,000 for the jail yard - $ 2,000,000 for the jail expansion - $ 300,000 for attorney fees - $ 34,692 to replace servers removed in evidence collection - Assorted associated loan costs and reserve All in total sum of approximately six and one-half million dollars ($ 6,500,000.00), for which sum the County intends to take a loan on terms, repaying the same from the tax monies collected under the special levy; and, WHEREAS, completion of the annex will require an additional two million dollars, ($2,000,000), above and beyond the costs thereof attributable to the judgment, together with associated loan costs and reserves, which sum the County intends to treat by separate Resolution; and, WHEREAS, pursuant to Section 2-9-316, MCA, the County Commission finds: a) No policy of insurance exists covering this judgment against Lake County; b) There are no funds in the county general fund or any other funds lawfully available to the Commission; c) And that as a consequence of the foregoing, the county’s sole option to fund its judgment liabilities above-referenced is imposition of a property tax in the form of a special levy in an amount necessary to pay any unpaid portion of the judgment or settlement; and, WHEREAS, the county anticipates that, if passed, the said associated special levy shall be in the sum of six million dollars, in two iterations; the first of three and one-half million dollars ($3,500,000.00) to be borrowed at an initial interest rate of five percent (5%) percent, the same to be repaid by the special levy collection in year to year; and, WHEREAS, if after three years from passage hereof, in 2027, the judgment project payment is incomplete, and the county has no general or other lawful funds to complete the judgement project and no coverage from existing insurance, the County intends to re-impose the subject special levy for collection of at least two and one half million dollars ($2,500,000.00), by way of loan on terms; and, WHEREAS, the County anticipates that the levy to be imposed shall amount to an estimated 11.59 mils, to be imposed initially for a period of three years and, if the conditions in the preceding predicate obtain, a reimposition of this rate, or another as the Commission may at the time resolve, for an additional three years. WHEREAS, no portion of the taxes collected pursuant to this subject, if passed, shall be due to the Polson Tax Increment Finance District, the same being a creature organized and in effect in respect of regular tax receipts and has no dependence on the judgment levy contemplated herein; and, WHEREAS, the Board of Lake County Commissioners will hold a public hearing on this Resolution of Intent at the hour of 10:00 am on the 22nd day of July, 2024 in the Commissioners Chambers located at 106 4th Avenue East, Polson, MT 59860 Room 211, for the purpose of taking public comment for or against the special levy as above-stated; and, WHEREAS, at such hearing, any person may appear and be heard for or against the proposed special levy, or submit relevant comments in writing, if preferred.
