PUBLIC NOTICE: The Board of Lake County Commissioners will hold a public hearing on Thursday, April 4, 2024 at 10:00 am in the Commissioners Chambers located inside the Lake County Courthouse at 106 4th Avenue East, Polson, MT 59860 for the purpose of taking public comment on the resolution listed below. RESOLUTION OF INTENTION 24-11 TO SETTLE LAWSUIT UNDER TERMS WHEREAS, Lake County, Montana, its Board of County Commissioners, and its Planning Board are all named Defendants in Lake County Cause No. Dv-22-153; and, WHEREAS, the Complaint in the aforesaid lawsuit seek relief of several forms, including, inter alia, money damages, equitable remedies, and a court-ordered adoption of certain regulations intended to provide for the regulated permitting of rentals for less than thirty days in the Rural Residential zoning district; and, WHEREAS, save and except the holding in Craig Tracts Homeowner’s Ass’n v. Brown Drake, LLC, 2020 MT 305, wherein the Montana Supreme Court found a short term rental consistent with ‘residential use only’ terms of the Home Owners Association, and Title 15 providing for collection of bed tax, the State of Montana has offered no unified guidance on rentals for terms of less than thirty days; and, WHEREAS, the parties have engaged in negotiating the bases of the complaint for the purpose of resolving the dispute in a manner economically favorable for Lake County and its taxpayers, as well as for reasons of judicial economy; and, WHEREAS, the Commission is informed and believes that rentals of less than thirty days, also known as vacation rentals or short-term rentals, exist in many zoned and unzoned areas of Lake County, and further that such rentals are, for many, an exercise of their private property rights and as well an efficient use of private property for the purpose of generating income; and, WHEREAS, the State of Montana having declined or failed to issue general guidance on the subject of rentals of less than thirty days, the Commission believes public order and safety requires a local system of regulation; and, WHEREAS, the Commission recognizes that short terms rentals represent an intersection of several public policies including housing, the respective private property rights of owners and neighbors, taxation and collection, and private and public economic efficiencies, among others; and, WHEREAS, the negotiations above-referenced have resulted in a tentative regulatory policy that appears to balance these several pertinent factors, and the Commission desires to hold a public meeting for the purpose of taking the input on these matters interested members of the public may care to share; and, WHEREAS, the proposed plan of regulation, which if approved will finally settle and adjust the issues in Lake County Cause No. 22-153, providing in toto a path to permitting rentals less than thirty days the Rural Residential zoning district, is available for inspection or copying in the office of the Board of County Commissioners: NOW, THEREFORE, BE IT RESOLVED: 1.
