PUBLIC NOTICE: The Board of Lake County Commissioners will hold a public hearing on Monday, June 17, 2024 at 10:00 am in the Commissioners Chambers located at 106 4th Avenue East, Polson MT 59860 Room 211, for the purpose of taking public comment on the resolution listed below. Resolution 24-18 of Intention to Create the Ponderilla Drive Rural Improvement District WHEREAS, the Board of County Commissioners received a petition from the majority of landowners in the proposed Rural Improvement District on April 19, 2024; and, WHEREAS, the Board of Lake County Commissioners intends to create the Rural Improvement District; and WHEREAS, the Boundaries of the district shall include all properties shown in the attached map; and WHEREAS, the nature of the improvement is drainage restoration, pulverizing existing surface, place and shape gravel roadbed topped by a 2” asphalt paving surface on Ponderilla Drive East for a distance of 3,650 approximately 18” wide, as shown on the attached map; and, WHEREAS, the petition was presented on the grounds and for the reasons that such road improvements and continued maintenance thereof are necessary for the elimination of dust pollution, safety, convenience and welfare of the undersigned, their successor and the public as a whole, and supported by 81% of the owners of the parcels to be taxed; and WHEREAS, Lake County Road Department shall perform all work; and WHEREAS, the total estimated cost of the project is $62,805, in which the Water District shall offset some $12,000, and an estimate of the total cost remaining payable by the freeholders is approximately $50,805.00 plus an administration fee of $500.00 and a reserve security of $2,540.25 (5 %), and an interest rate to be determined at the time of securing the loan therefore; and, WHEREAS, the Board of Lake County Commissioners will hold a public hearing on Monday, June 17, 2024, at 10:00 am in the Commissioners Chambers located at 106 4th Avenue East in Polson, MT 59860; and WHEREAS, prior to and at that public hearing the Board will take oral or written public comment and protest, if any, prior to making a final decision as to the petitioned Rural Improvement District; and, WHEREAS, the assessment of costs shall be divided equally per tax ID # among the 22 properties within the proposed district, to either be prepaid as provided herein, or placed on their annual tax bill for the next ten years, for a total estimated per Tax ID# of $2,447.00 (plus interest); and, WHEREAS, if an increase occurs in the number of benefited lots, tracts, or parcels within the boundaries of the district during the term of the bonded indebtedness, the assessment per lot, tract, or parcel then in the district will be recalculated as provided in 7-12-2151(4)(a); and, WHEREAS, the commission contemplates that, if enacted, taxpayers shall be afforded a prepay period until August 15, 2024 for those wishing to prepay their portion, and, if such prepayment is not received, the amounts will be assessed on the annual tax bill for a period of ten years beginning November of 2024, together with interest to be determined at final hearing, financed by bank to be determined at final hearing; NOW, THEREFORE BE IT RESOLVED, that the Commission will hold public hearing on the petition to establish the Ponderilla Drive Rural Improvement District on the 17th day of June, 2024, at 10:00 am in the Commissioners Chambers located at 106 4th Avenue East, Polson, MT 59860, no less than thirty days following notice thereof by publication in the newspaper as provided by law.
