Kalispell man charged with rape

A Kalispell man who was on probation for a prior rape conviction in Flathead County is accused of forcing himself upon a woman he met on social media. Fabian Alexander Perez-Calderon, 25, entered a plea of not guilty to felony sexual intercourse without consent in District Court in Polson on Nov. 13.

According to court records, on March 16, 2024, law enforcement met with the alleged victim in the case. The woman indicated that she met Perez-Calderon on Facebook and agreed to meet. Perez-Calderson said he would bring alcohol to the meeting.

The woman said when they did meet, and they were alone, Perez-Calderon aggressively attempted to kiss her. She asked him to leave and thought he did.

She said a little later when she was in bed, she looked up and Perez-Calderon was standing in her room naked. She said he grabbed her hair and she tried to tell him he was hurting her and started to cry.

Perez-Calderon then allegedly stated “don’t you find me attractive?” before he removed her shorts. He then allegedly put his hand over her throat, grabbed her hair and forcibly raped her. The woman indicated that she had been drinking.

Records show Perez-Calderon was on probation for sexual intercourse without consent in Flathead County. 

According to an article published in the Daily Interlake March 24, 2023, Kalispell Police Department detectives had launched an investigation after meeting with Perez-Calderon's victim in May 2019. According to court records, the incident followed a bonfire party involving alcohol. The two had driven to an apartment complex afterward and Calderon pinned her down in the backseat of a vehicle and raped her.

He was also charged with assaulting a man with a skateboard, according to that same article. Perez-Calderon received a 10-year suspended sentence for the rape conviction and a five-year suspended Department of Corrections term on the assault.

Judge Molly Owen set the current case for trial May 5, 2025. Perez-Calderon remains in the Lake County Jail with bond set at $50,000.
