If you would like to comment but are unable to attend or have further questions, please contact the Commissioners Office at 406-883-7204 or by email to lakecommissioners@lakemt.gov Resolution 24-36 A RESOLUTION OF INTENT TO CREATE THE BRIARWOOD CIRCLE ROAD PAVING SPECIAL DISTRICT WHEREAS, The Lake County Commission has received a petition signed by at least 40% of the owners of the real property within the boundary of the proposed special district in and around, Mission View Tracts, a subdivision in the NW4NW4 S32,T23N, R20W, on file and of record in the office of the Clerk and Recorder, Lake County; Consisting of eighteen (20) individual parcels, the descriptions thereof available for examination at the office of the Lake County Commission; and, WHEREAS, the said Petition requests creation of a special rural improvement district for road paving, for the purpose of improving the dedicated county road within said area, including Briarwood Circle, for the purpose of reconstruction and asphalt paving of the existing Briarwood Circle Road, pleading the necessity of safety, convenience, and welfare of the Petitioners; and, WHEREAS, the said petition contemplates that each of the parcels to be benefitted by the said re-pavement should also bear the burden thereof; and, WHEREAS, the said Petition proposes that the project contemplated within to include the following work, to wit, remove existing asphalt from the entire road; excavate eight inches of base; stake sub grade; grade and compact new 5-inch aggregate, blue top stake base, place, grade and compact 3 inches of new base course; surface all with a compacted three-inch lift of asphalt; to include raising the approach to Highway 93 from the edge of the highway inward approximately 20 lineal feet to an additional 1.5 feet, including removal of unsuitable materials; place geotextile fabric; place, grade and compact at 15-inch lift subbase gravel; blue to stake; place 3-inch lift of base aggregate and surface with a compacted 3-inch lift of asphalt; and, WHEREAS, the cost is anticipated to be one hundred ninety three thousand eight hundred dollars ($193,800.00), an administrative cost of five hundred dollars ($ 500.00), and an additional five percent (5%) reserve, amounting to ten thousand dollars ($10,000.00), for a total cost of two hundred four thousand three hundred dollars ($204,300.00) at an interest rate to be determined at the time of securing the loan therefor; and, WHEREAS, Smith Paving and Contracting, or Polson, MT, or any qualified replacement contractor, shall perform all work; and WHEREAS, the Board of Lake County Commissioners will hold a public hearing on Tuesday, November 12, 2024 (date) at 10:00 am in the Commissioners Chambers located at 106 4th Avenue East in Polson, MT 59860; and WHEREAS, due to the limited lifespan of the road paving special district proposed herein, the board of County Commissioners shall oversee and administer the District during it’s existence; and, WHEREAS, if an increase occurs in the number of benefited lots, tracts, or parcels within the boundaries of the district during the term of the bonded indebtedness, the assessment per lot, tract, or parcel then in the district will be recalculated as provided in 7-12-2151(4)(a); and, WHEREAS, the commission contemplates that, if enacted, taxpayers shall be afforded a prepay period until June 2, 2025 (date) for those wishing to prepay their portion, and, if such prepayment is not received, the amounts will be assessed on the annual tax bill for a period of ten (10) years, beginning November, 2025, together with 4.5% interest, on the terms as financed by Trailwest Bank; and, WHEREAS, prior to and at that public hearing the Board will take oral or written public comment and protest, if any, prior to making a final decision as to the road paving project herein; and, WHEREAS, because there are equal benefits to all the parcels to be levied, if enacted the assessment of costs shall be divided equally per tax ID # among the 20 properties within the proposed district, to either be prepaid as provided herein, or placed on their annual tax bill for the next ten years (plus interest), for a total estimated cost per Tax ID# of $2,622, plus the pro rata share of any interest on the necessary financing note; and, WHEREAS, if enacted, it shall be known as “Briarwood Circle Special District.” NOW, THEREFORE BE IT RESOLVED, that the Commission will hold public hearing on the petition to establish the Briarwood Circle Special District on the Tuesday November 12, 2024, no less than thirty days following notice thereof by publication in the newspaper as provided by law.
