RESOLUTION OF INTENTION # 25-25 A Resolution of Intention to Fund Kings Point Maintenance District Infrastructure Maintenance WHEREAS, the Board of County Commissioners received a petition from the Kings Point Maintenance District on May 19, 2025; and, WHEREAS, the said Petition prays for an amendment to the existing Maintenance District, for the purpose of refurbishing road infrastructure at a cost over and above the annual maintenance costs, all pursuant to 7-12-2102, MCA; and, WHEREAS, the petition was presented on the grounds and for the reasons that such road improvements and continued maintenance thereof are necessary for the proper maintenance and continued viability of the roadway, and the safety, convenience and welfare of the District residents and users, their successors, and the public as a whole; and WHEREAS, the boundaries of the District remain the same, to wit: Boundaries All as reflected on Exhibits A and B hereto; and, WHEREAS, the refurbishment of infrastructure consists of two parts, namely, part one, a double-shot chip seal at a bid cost of $147,400.00, and part two, structural upkeep on the causeway foundations, at a bid cost of $9,940.00, less $10,000.00 to be contributed by the Kings Point Maintenance District, together with a 5% administrative fee in the amount of $7,370.00, and financing costs to be determined at the time of securing the loan, for a total prayer of $154,710.00, plus financing costs; and, WHEREAS, the assessment of costs shall be divided equally per tax ID # among the 88 properties within the proposed district, to either be prepaid as provided herein, or placed on their annual tax bill for the next ten years (plus interest), for a total estimated per Tax ID# of approximately $ 1,758.00; and, WHEREAS, if an increase occurs in the number of benefited lots, tracts, or parcels within the boundaries of the district during the term of the bonded indebtedness, the assessment per lot, tract, or parcel then in the district will be recalculated as provided in 7-12-2151(4)(a); and, WHEREAS, the commission contemplates that, if enacted, taxpayers shall be afforded a prepay period until DATE for those wishing to prepay their portion, and, if such prepayment is not received, the amounts will be assessed on the annual tax bill for a period not to exceed 10 years beginning November of 2025, together with INTEREST PERCENTAGE (to be determined) % interest, financed by BANK(to be determined); and, WHEREAS, the Board of Lake County Commissioners intends to grant the Petition to fund necessary infrastructure improvements in the Kings Point Road Maintenance District under the terms above-described; and WHEREAS, the Board of Lake County Commissioners will hold a public hearing on July 21, 2025 at 10:00 am in the Commissioners Chambers located at 106 4th Avenue East in Polson, MT 59860; and WHEREAS, prior to and at that public hearing the Board will take oral or written public comment and protest, if any, prior to making a final decision as to the petitioned Rural Improvement District; and, NOW, THEREFORE BE IT RESOLVED, that the Commission will hold public hearing on the Petition above-described on the 21st day of July 2025, at 1:30 pm in the Commissioners Chambers located at 106, 4th Avenue East, Polson MT 59860, no less than thirty days following notice thereof by publication in the newspaper as provided by law.
