Beginning at the Northeast corner of said Section 36, thence west 518 feet, thence south 15 degrees 48 minutes east 1372 feet, then east 142 feet, then north 1320 feet to the point of beginning. Containing ten (10) acres, more or less. Whereas, MCA 7-8-2212 provides that surplus county property may be sold at public auction; and, Whereas, the sale may not be made for less than 90% of the appraised value of $180,000.00 (one hundred eighty thousand dollars). NOW, THEREFORE, BE IT RESOLVED: 1. That the above-described real property is excess to county needs, and shall be noticed for sale by public auction in the manner provided by law, the County reserving the right to reject any and all bids, and subject to any other terms appearing herein or under Montana law. 2. A sale under this part must be for cash or on terms that the Board of County Commissioners may approve, provided the price is at least 90% of appraised value, and provided that at least twenty percent of the purchase price is paid in cash. All deferred payments on the purchase price of any property sold must bear interest at not less than 6% per annum, payable annually, and may be extended over a period of not more than five years. 3. Title to the real property to be sold hereunder may not pass from the County to a purchaser until the purchaser or his or her assigns have paid the full amount of the purchase price into the county treasury for the use and benefit of the County. 4. Hearing on this Resolution of Intention shall be held at 2:30 pm on the 21st day of July, 2025, at the office of the Lake County Commission, 106 4th Avenue East, Polson, Montana, Room 211. 5.
