RESOLUTION NUMBER 2024- 19 A RESOLUTION OF INTENTION OF THE COUNTY COMMISSION OF LAKE COUNTY MONTANA, TO PROVIDE FOR A NOTICE OF DEVELOPMENT OF REAL PROPERTY WHEREAS, Lake County maintains and administers a system of land development through its planning and environmental health departments; and WHEREAS, the said County development regulations exist and have their respective application in discrete geographic areas of Lake County; and, WHEREAS, the County finds that development of land to residential or commercial purposes increases the taxable value of such developed parcel, and further finds that the present mechanism of property assessment does now always capture such development and increased taxable values, incrementally increasing the fiscal burden on all other parcels properly assessed and levied; and, WHEREAS, a recent legislative audit of the Montana Department of Revenue estimated $300 million of new construction in the State had not been added to the tax rolls in 2024; and, WHEREAS, the legislative audit recommended that counties share information to the Department that would facilitate the addition of new construction to the tax rolls; and, WHEREAS, it is the intention of Lake County to require any person or firm, principal or agent, proposing to build or construct any development on any parcel of real property within Lake County, to first acquire a Countywide Notice of, New Construction as further set forth herein; and, WHEREAS, the public purpose of such notice is to create and maintain an accurate record of accessions to real property value throughout Lake County, for the purpose of apprizing the Montana Department of Revenue of such increase in value, for appropriate action by its assessors, in order to strengthen the fairness and universality of proper real property taxation for all County taxpayers. WHEREAS, the Lake County Commission is considering adopting a resolution of the following terms: Each person, firm, or corporation must, prior to beginning any development of any kind of real property located within the exterior boundaries of Lake County, wherever situate, shall file an appropriate Countywide Notice of New Construction with Lake County Planning, substantially in conformance with Exhibit A hereto, of such proposed development, and receive an Acknowledgement of such filing; and, “New construction” that requires the developer to file its Notice of New Construction for any of the following improvements, as defined at Section 15-1-101(1) (j), MCA, as follows: All buildings, structures, fences, and improvements situated upon, erected upon, or affixed to land, including a mobile home, manufactured home, or housetrailer has been established, the mobile home, manufactured home, or housetrailer is presumed to be an improvement to real property, where such mobile home, manufactured home, or housetrailer when it is attached to a foundation that cannot feasibly be relocated and only when the wheels are removed. It is the specific intent of the Commission that this Resolution shall apply to the underlying owner of any property developed or to be developed, and as well ANY AND ALL agents, representatives, or contractors in the employ of said owner, each of whom shall bear joint and several responsibility therefor; and, Any penalties incurred hereunder shall be in addition and supplemental to any penalties assessed pursuant to Lake County building and environmental regulations. NOTICE FOR PUBLIC HEARING LAKE COUNTY HEARING TO ASSESS AND PRIORITIZE NEEDS The Lake County Commissioners will hold a public hearing on Tuesday, May 20 at 2:00 PM in the Commissioner’s Meeting Room at 106 4th Avenue East, Polson, MT 59860. The purpose of this hearing is to obtain public comments regarding what they perceive as the priority needs to be addressed by the County for public facilities, infrastructure, affordable housing, economic development and other community revitalization efforts. For municipalities and/or sewer/water districts, and organizations considering applications for funding to the Montana Community Development Block Grant Program (CDBG), which provides funding for projects serving predominantly low-moderate income persons, this hearing may serve as the required “first public hearing” as needed to assess and document local project needs. Those considering such projects are encouraged to attend as the County is the required applicant for unincorporated towns and districts. Copies of minutes will be provided for documentation.
